This report will indicate the status of the Project and compliance with the conditions of approval for the ~:`x`-, Ordinance, which changed the zoning designation of 14.85 acres from Agriculture (A1-a) -a P9;::<~°~$` to Resort (V-6.0}. t\<a~~f1t ~7~~r' '1"` As you know, in a letter dated February 28, 2002 from your office, we were granted an administrative time extension of compliance for all conditions of approval for the above- " 4,4, referenced Change of Zone Ordinance until March 13, 2007. We fully appreciate your 1~:, favorable consideration for our ongoing efforts in proceeding to comply with the a roved conditions of approval. Therefore, while we have additional time to comply .~s with the conditions of approval, we would like to give you a bne overview of w ere we ~,;~,~-;s;;- ,i,i, are at on the Project and how we are proceeding with complying with the conditions of Syk~~i=i t~¢g j3 approval of Change of Zone Ordinance No. 97-36. Oceanside submitted an Integrated Archaeological Mitigation Plan ("IAMP") for review ,j~3,.~9~{: and approval to DLNR-SHPD in 1999. The IAMP includes a Data Recovery Plan and ,::F,.,~~~ Research Design, a Preservation and Interpretive Plan, and a Monitoring Plan, and a ~l#_ Mitigation and Management Plan for the State-owned old govermnent road and was eA; approved by SHPD on September 1 S, 1999. Under separate cover, a Burial Treatment ,f^4 Plan was prepared and submitted to the State Historic Preservation Division in 1999. g:.....:~i<~__ ;;t5~ Final recommendation and site treatments were approved by SHPD in November 1999. Work under the approved data ~8~~-=~>::: p recovery work is nearly complete. p ~ ,z~,. Progress on the Bypass will allow us to fulfill Condition K in the Ordinance. .~#s~v,ta~~~~ '`?3'.% 3~`a cg~~ty;;gG' ~rs•`~F•, Subdivision and Final Plan Approval t„~;r,~~~,, Our subdivision and Final Plan Approval plans for the Lodge are still being coordinated , ,;,3Y,,,;~., with the other applicable conditions of approval that affect this part of the Project and preliminary plans are in the process of review and revision. We would note that p,='~z;p Oceanside has received final subdivision approval for Phase 1 and Phase 2 of the `~g~i ,,;fit :~`~a:~,~>= agricultural lot development. We are in an ongoing process for this subdivision phase of ;~~,f, ss a~,~lhpt~~;~:~ the Project. Also, the department granted a five year extension of time to gain plan ,ks~'~;~y~~, approval from the County. +jP g'ptlt¢%~fi~' Development Agreement '~44gt:.ys~v r p,,,;! Oceanside 1250 and the Count of Hawaii entered into a develo ment a Bement to identify the obligations of Oceanside to provide assurance that these obligations are met ''~~"`'s>~'~~ in a timely manner, to provide assurances to Oceanside that it may complete full `:1~, development of Hokuli'a, including the Project, to allow Oceanside and the County to enter a reimbursement agreement for costs associated with the Bypass, and to reduce or = t,,,,.~,;, eliminate uncertainty in the responsibilities of Oceanside and the County. All activity F=... ,;a,'~,,~?, related to the Lodge parcel is consistent with the terms and conditions of the agreement. ,~~lz~„~,~;. This progress on the development agreement will, in part, allow us to fulfill the terms of ,,,~~,r=;~~;~ Condition K in Ordinance 97-36. =`a r •E; ' S ecial Mana ement Area y Oceanside has submitted an SMA Permit to the County for the Lodge and its related uses _ on January 14, 2000, and hearings and action. Specifically, the funding level would be tied +~E.Y;,3 - to the number of lodge units rather than the projected number of employees, as is the case for the Golf Course and Clubhouse Employee Housing Program. ~~~~~~ra1~~~,r Y- . In order to ensure that the greatest number of employees benefit from this program, Oceanside has formulated the Program such that the funding level is based on 50% of the a„~;,,,,~?Rs number of units within the Members' Lodge facilities, which represents the maximum ::ti':: ratio allowed under Section 11-5 of the County Affordable Housing Policy. ~~z~ ~~.e^e+R6ji We understand, that following approval of the program by the Planning Director and :;a~}~:K~:q. County Housing Agency, Oceanside would enter into an agreement with the Mayor for ,,y, ;n, the implementation of the Program. We believe that, in addition to fully meet the °1_~yi"'t~~~ requirements of Condition M of Ordinance 97-36 and the County Affordable Housing ~~~~?;D'~`>' Polic the ro osed ro am will rovide meanin ful benefits to those Hokulia Lod e Y, p p p P g g ~ employees seeking to move toward home ownership.
