Akana dated April 7, 1989, submitting for confirmation, the following appointment to the Kailua Village Design Commission: Irene W. Croft Jr., a resident of Kailua, to fill the expired term of William L. Wong. Ms. Croft will serve until December 31, 1991. Comm. 387: REZONING AND STATE LAND USE BOUNDARY AMENDMENT REQUESTS HOLUALOA MANAGEMENT CORP. & GRANT KOLNES (C-304 & 338) From Brad Houser, P.E., dated April 5, 1989, commenting on statements made in Communications 304 and 338, regarding the rezoning and State Land Use Boundary Amendment requests for Holualoa Management Corporation and Grant Kolnes. Comm. 400: APPOINTMENT - KAILUA VILLAGE DESIGN COMMISSION From Mayor Bernard K. Akana dated April 14, 1989, submitting for confirmation, the following appointment to the Kailua Village Design Commission: Diane S. Vey, a resident of Kona, to fill the expired term of R. Kelly Greenwell. Ms. Vey will serve until December 31, 1991. Comm. 405: APPOINTMENTS - ARBORIST ADVISORY COMMITTEE From Mayor Bernard K. Akana dated April 13, 1989, advising that the Arborist Advisory Committee has been re-established by the appointment of the following individuals: Mr. David Y. Quentin Tomich of Hamakua, a conservationist and retired animal ecologist with the State Department of Health; Ms. Arlene Wakefield of Kona, owner/operator of Wakefield Gardens; Mr. Duane Kanuha, Planning Director, who may be represented by a designee in Committee matters. Comm. 406: AMENDMENT TO THE SUBDIVISION CODE, BILL 53 COMM. N0. 248 From Planning Director Duane Kanuha dated April 11, 1989, informing they have reviewed Bill 53, relating to non-dedicable, private dead-end streets, and requests deferral of this matter. States, in lieu of proposing piecemeal amendments to the Subdivision Code relating to roadway standards, perhaps a comprehensive review of those sections of the Subdivision Code should be considered; further, any changes related to roadway standards should be reviewed and coordinated with the Department of Public Works. Comm. 411: APPOINTMENT - KAILUA VILLAGE DESIGN COMMISSION From Mayor Bernard K. Akana dated April 17, 1 89, submitting for confirmation, the following appointment to the Kailua Village Design Commission: Gerry L. Rott of Kona, to fill a vacancy created by the resignation of Robert T. Mento. Ms. Rott will serve until December 31, 1990. Comm. 415: APPOINTMENT - ARBORIST ADVISORY COMMITTEE From Mayor Bernard K. Akana dated April 19, 1989, advising he has appointed Erika Kurz of Puna as a member of the Arborist Advisory Committee. Ms. Kurz, a retired airline employee, will serve until December 7, 1992. Comm. 416: "AGRICULTURAL CONDOMINIUM" DEVELOPMENT (H.C.R. No. 293 AND H.R. No. 319) From Planning Committee Chairman Takashi Domingo dated April 19, 1989, transmitting copies of Standing Committee Report No. 1535, regarding H.C.R. No. 293, and Standing Committee Report No. 1596, regarding H.R. No. 319, which he received from Representative Virginia Isbell. Krieger dated October 3, 1988, submitting a bill to change the district classification for 22,940 square feet of land from a Single Family Residential - 15,000 square foot (RS-15) to a Neighborhood Commercial - 10,000 square foot (CN-10) zoned district at Waiohinu, Ka'u. Comm. 1803.1: From Sidney M. Fuke, Principal, Sidney Fuke & Associates, dated November 1, 1988, addressing concerns raised at the Planning Committee's October 1.1, 1988 meeting regarding the rezoning request of Ray Fujikawa. Comm. 1803.2: From Sidney M. Fuke dated November 15, 1988, requesting that the rezoning request of Raymond Fujikawa be deferred until further notice. Comm. 336: From Ray M. 5hirakawa dated March 16, 1989, commenting on the rezoning request of Raymond Fujikawa. Comm. 101: AGRICULTURAL CONDOMINIUM Copy of letter to Planning Director Duane Kanuha from Mark Van Pernis of Gallup & Van Pernis, Attorneys At Law, dated December 27, 1988, informing of an attempt to create an "Agricultural Condominium", which he feels, if successful, would not be in compliance with applicable subdivision law and would result in property being used as a subdivision and burdening County or State governmental services without any compliance with applicable subdivision law or providing needed infrastructure. States the Legislature should revise its Horizontal Property Regime laws to preclude use of agricultural land for any kind of "condominium" and that the County, particularly the Planning Department, should recognize "agricultural condominiums" for what they are, i.e. subdivisions, and not allow them to take place without meeting all applicable subdivision laws. Comm. 118: Copy of letter to Mark Van Pernis, Attorney at Law, from Acting Planning Director Duane Kanuha, dated PC-7 Page 4 April 26, 1989 (C-118) January 18, 1989, requesting specific information on (cont'd) Communication 101. Comm. 392: From Legislative Assistant Tadato Nagasako dated April 13, 1989, commenting on Communication 101 and agricultural condominiums, as requested at the Planning Committee's January 25, 1989 meeting. Comm. 141: REZONING REQUEST - DAVID AND IVAN BASQUE (Bill 29) HONUAINO 3RD, NORTH KONA TAX MAP KEY 7-9-07:53 (0.49 acre) From Planning Commission Chairman Gary Mizuno dated January 25, 1989, submitting a bill to change the district classification for 0.49 acre of land from Single Family Residential (RS-10) to Village Commercial (CV-7.5) at Honuaino 3rd, North Kona. Informs the Commission concurs with the Planning Director in recommending denial of the application for reasons, as listed. Comm. 351: From Planning Director Duane Kanuha dated March 16, 1989, informing they have reviewed the modification of David and Ivan Basque's rezoning application and that the new proposal was transmitted to the Department of Public works and the Department of Water Supply (DWS) for review and comment. States, even with the new proposal, DWS informs that the existing water system facilities cannot support the proposed development; as such, Planning Department is maintaining their denial recommendation. Comm. 262: NOISE PROBLEM - KONA PLAZA CONDOMINIUM - KAILUA-KONA From Charles w. Davis dated February 8, 1989, transmitting related correspondence regarding the noise problem at the Kona Plaza Condominium in Kailua-Kona and copy of a petition requesting a noise ordinance. Comm. 374: From Chief Engineer Hugh Y. Ono dated April 4, 1989, transmitting for information, a copy of their letter to Jane Abbott of Koloa Management Co., informing of the Council's serious concern regarding the air conditioning noise levels at the Kona Plaza Condominium.
