This work involves the completion of the University of Hawaii at Hilo, University Park, Phase IIB, Water System Improvement project which was initially started by the State but then delayed by the damages caused by the November 2000 flood. Due to overlapping work areas and scheduling conflicts between the State and the County's Puainako Street Extension project contractors, it was agreed that the County would complete the waterline work with State funding. In order to expedite this matter and have the funds appropriated this fiscal year, the Department of Public Works would like to request a waiver from the Finance committee and have this bill heard at the Council meeting scheduled for June 5, 2002. REQUEST: Amendment to Ordinance Bill 01-56 to add Puainako Street Extension (Kaumana Drive to Komohana Street) project. Work to include completing the construction of the University of Hawaii at Hilo, University Park, Phase IIB, Water System Improvements project. B. BACKGROUND AND JUSTIFICATION FUSE ADDITIONAL SHEETS AS NEEDED): This project was initially a State of Hawaii Department of Accounting and General Services (DAGS project which was scheduled for completion prior to the start of Puainako Street project. Unfortunately, the flood of November 2000 caused severe damage to the DAGS project with resulting delays. Due to overlapping work area and the scheduling conflicts between the DAGS contractor and the County contractor, an agreement was executed between DAGS and the County to have the County contractor complete the waterline work with DAGS funding. This appropriation for $1,405,000 of State funds will be used for the construction of this project. See attached Memorandum of Agreement for further details. Job No. 11-31-4049 Background and Paarpose The State of Hawaii Department of Accounting and General Services (STATE) entered into an agreement with its contractor, Jas. W. Glover, Ltd., for construction of the University of Hawaii at Hilo, University Park, Phase IIB, Water System Improvements project, D.A.G.S. Job No. 11-31-4049, under Contract No. 45736. The STATE project includes construction of a 1.0-million-gallon reservoir and transmission lines to flat University of Hawaii at Hilo to service the campus. On November 2000, storm waters caused severe damage to the STATE project under construction. Construction was stopped in order for the STATE to evaluate its repair alternatives, funding sources, and course of action. The County of Hawaii Department of Public Works (COIJNT'Y) has entered into an agreement with its contractor, Goodfellow Bros., Inc., for construction of the Puainako Street Extension project, Federal-Aid Project No. STP-2000(4), COH Job No. 3497, under Contract No. 01159. The COUNTY project will construct a new two-lane highway approximately 4.5 miles between Komohana Street and Kaumana Drive near the Country Club Road. The COUNTY project will overlap the STATE prof ect azeas~ generally where Waterline "B"occurs, by building over and partially demolishing the STATE improvements. Originally, the STATE project would have been completed prior to the COUNTY's project starting work in the area. As a result of the storm damage, the delay in the STATE project will negatively impact the COUNTY project. Based on the foregoing, it is mutually agreed that the repair work and remaining balance of the STATE project will be completed by the COUNTY with its contractor. The major benefit is that the conflicting work can be coordinated by the COUNTY, under one project contractor for a benefit to both the STATE and COUNTY. Stimulations 1. The STATE will provide up to $1,405,000 in insurance funds to the COUNTY. Payment from STATE to COUNTY will be on a monthly reimbursable basis. 2. The STATE will be responsible for completing the Water System Improvements project in accordance with Change Order No. 11 to Jas. W. Glover, Ltd. Contract No. 45736, which incorporates Post Contract Document No Sa (PCD-Sa). PCD-Sa essentially includes completion of the reservoir and the reservoir site. In addition, the STATE shall: 1 ' a. Provide a guarantee against defects in materials, equipment or workmanship for one year from the respective acceptance dates for all work in Change Order No. l l , Waterline C and the PRV station work in the University Park. If, within the guarantee period, repairs or changes are required in connection with the guaranteed work, which is necessary due to materials, equipment or workmanship which aze inferior, defective or not in accordance with terms of the Contract, the STATE shall correct all defects and, if applicable, repair all related damages. 3. The COUNTY will be responsible for repairing the STATE's storm-damaged areas in accordance with Change Order No. 1 to Goodfellow Bros., Inc. Contract No. 01169. Change Order No. 1 generally rebuilds the STATE's remaining portions of Waterline "B," Waterline "A," Waterline "A1," Maintenance Road "A," Access Road and the Reservoir Site Road. In addition, the COUNTY shall: a. Maintain the reservoir after tested and approved for acceptance by the STATE. The COUNTY rxiay aarange to transfer the maintenance responsibility to the County of 1'lxawaii Department of Water Supply (DWS). b. Complete all necessary and required testing of the constructed waterline facilities and transfer to the DWS a coanplete working system to their satisfaction. c. Provide construction quality control and assurance, including soil testing and earthwork inspection services for all work performed by the COUNTY contractor. d. Provide a guarantee against defects in materials, equipment or w®rkmanslup f®r One year from the Project Acceptance Date for all work completed in the COUNTY Change Order No. 1 and for the portion of Waterline )8 previously installed by the STATJ~'s contractor. Notice to Proceed Notice to Proceed (NTP) for Change Order No. 1 shall not be issued until the cost for the work by the COUNTY is approved by the STATE. Funds will not be reimbursed to the COUNTY for activities conducted prior to the date of NTP, unless approved by the STATE. 5. Amendment, Modification, and Termination This Memorandum of Agreement (MOA) may be modified or amended only by written, mutual agreement of the parties hereto. Proposals for modification or amendment will be circulated to all signatories fora 10-day period of review. Approval of such proposals will be indicated by written acceptance. 6. Pursuant to Section 1(g) of Rule 4 of the Rules of Procedure of the Council of the County of Hawaii, this written request is submitted with my approval that the above-referenced matter be waived from the Committee on Finance to the full Council for immediate action. In reviewing this matter, timely approval is crucial. It is therefore advantageous that approval is granted and the matter placed onto the next Council agenda for review.
