Dear Chairman Arakaki and Council Members:
Enclosed is a bill for an ordinance amending Chapter 19, Article 11, Section 19-90(g) of
the Hawaii County Code relating to the minimum tax.
On October 8, 2001 we transmitted a bill (Bill No. 121) amending this same section. Bill
No. 121, Draft 3, passed the County Council on December 19, 2001 and became effective
without Mayor Kim's signature in January. Mayor Kim did not sign the bill because he
felt that the final draft was not a fair one. It retained the $25 minimum tax for persons in
the Homeowners Class and totally disabled veterans.
Mayor Kim believes very strongly that to be fair, any exception to the $100 minimum tax
should be based on the values of qualifying properties and/or the owner's ability to pay.
Bill No. 121, as amended, did not do this.
The bill that is being submitted will essentially amend Chapter 19 to carry out the
original provisions of Bill No. 121.
