BILL 223 TO AMEND CIIAPTER 12, IIAWAII COUNTY CODE, RELATING TO IMPROVEMENT
DISTRICTS
I am writing to urge your support and adoption of Bill 223. This Bill was carefully prepared with mucl: input
from the Department of Water Supply, the Department of Finance, and bond counsel. It is intended to broadly
facilitate the Improvement District process.
Specific411y, it will immediately assist the proposed Water System Improvement District for the Kona
Coastview ;.nd Kona Wonderview subdivisions. This is a project strongly supported by the Water Board. It will
solve a longstanding problem of over 400 Kona homeowners.
In acknowledgement of the USDA Federal grandloan financing package for the proposed
Coastview/Wonderview Water Improvement District, Bill 223 allows fora 35-year period to permit the pa;~;nent
of principle for an Improvement District bond. It also settles the matter of payment of any cash refunds upon
termination of an Improvement District. It provides clear definitions of assessed owners and protocols to assure
that property owners in any proposed Improvement District will receive fair and sufficient notice of proposed
assessments.
These and other provisions will smooth the process to move forward with the upcoming Coastview/Wonderview
project. They will also enhance the ability of the County Council, Department of Water Supply, and
Department of Public Works to employ the funding mechanism of our Improvement District Ordinance for
many other needed infrastructure projects throughout Hawaii County in the years ahead.
