Subject: Request for Administrative Tithe Extension

This is to acknowledge receipt on May 8, 2002 of a request to grant an administrative time
extension to Condition C, pursuant to Condition L of the above referenced ordinance.
The reason given for this request is that various financial and other unforeseen considerations,
including the extended illness and subsequent death of co-owner/developer Jane Alice Wilson,
precluded compliance with all conditions.
Ordinance No. 97-101 became effective July 14, 1997. Condition C required Final Subdivision
Approval within five (5) years from the effective date of said Ordinance, or by July 14, 2002.
Since non-performance is the result of unforeseen conditions and the granting of a time extension
is not contrary to the General Plan, the Zoning Code, or the original reasons for granting the
rezoning, the Planning Director hereby grants a five (5) year administrative time extension to
Condition C, or until July 14, 2007.
For your added information, according to the September 26, 1997, Department of Water Supply
memorandum, your water commitment deposit expired on September 30, 2000.
