No. 207-02 PLACE: Council Chambers TIME: 10:07 a.m. Council Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Finance, to which was referred Resolution No. 207-02, reports as follows: Resolution No. 207-02, transmitted by Director of Finance William Takaba, via Communication No. 604, dated April 17, 2002, authorizes the Director of Finance to negotiate a lease of the East Hawaii Cultural Center to the East Hawaii Cultural Council. The County of Hawaii is the owner of the East Hawaii Cultural Center located at 141 Kalakaua Street, Hilo, Hawaii identified by Tax Map Key 2-3-6:04. The East Hawaii Cultural Council, anon-profit organization, is desirous of obtaining a long- term lease of the East Hawaii Cultural Center to preserve and develop the cultural, creative, and traditional arts of the various ethnic groups that make up the population of the East Hawaii and to stimulate community interest, involvement, and support of arts and culture in East Hawaii. Pursuant to Section 2-120, Hawaii County Code, the Council of the County of Hawaii may, by resolution approved by a majority of its members, direct the finance director to negotiate the lease of real property to non-profit organizations, at such rentals and on such terms and conditions as deemed proper. Also, pursuant to Section 2-120, Hawaii County Code, such lease of real property to non-profit organizations may be made without the notice or appraisal as required in Chapter 2, Article 19, Hawaii County Code. Your Committee heard testimony in favor of the measure from Sudhar Achar, Patrick Freehill, Michael Marshall, Patrick Kahawaiola`a, Ken Charon, Marlin Spike Werner, George Jacob, Lewis Moore, Paul Mark Clark, Tomas Belsky, Steve Slater, Kenneth Charon Sr., and Gay Tolar. In additional to supporting the resolution, the testifiers requested the term of the lease be amended to 20-year term in lieu of a 10-year term. Some members of Your Committee expressed concerns over the cultural center's services on both East and West Hawaii. Another concern was the rental sum of $1.00 per year for the term of the lease, as a member of Your Committee felt that other non-profit agencies should have similar rental costs such as the Waimea Arts Center. FC REPORT NO. 228 Your Committee, during its discussion of Resolution No. 207-02 felt that a longer term lease was reasonable to help with financing for capital improvements, and made the following amendment to the resolved clause "...authorized to negotiate a 20_•~ lease (with renewal options of two-5 wear periods) with the East Hawaii Cultural Council, a nonprofit organization, without notice or appraisal, for the East Hawaii Cultural Center." For informational purposes, Mr. Tyler voted kanalua twice.
