Your Committee on Finance, to which was referred Resolution No. 180-02, reports as follows:
Resolution No. 180-02, transmitted by Director of Finance William Takaba, via Communication
No. 545, dated March 6, 2002, authorizes the payment of funds of a later fiscal year and of more
than one fiscal year for animal control services.
The County desires to contract with an organization for animal control activities pursuant to
Chapters 46 and 143, Hawaii Revised Statutes, and Chapter 4, Hawaii County Code which
authorize the County to regulate a variety or animal activities. Further, the County finds it is in
the best interest of the County that the contract for animal control services covers more than one
year. Therefore, the County has issued a Request for Proposal seeking to contract with an
organization to provide animal control services for a period up to June 30, 2005, with the option
of extending the contract in increments of one-year periods ending June 30, 2007.
Pursuant to Section 143-15, Hawaii Revised Statutes, the County may contract with any society
or organization formed for the prevention of cruelty to animals for the seizure and impounding of
all unlicensed dogs and for the maintenance of a shelter of pound. Further, Section 4-6, Hawaii
County Code, authorizes the County Council to appropriate funds for stray dogs, cats and small
domesticated animals and for the assistance of societies to accomplish the related responsibilities
which are delegated to the societies. Lastly, Section 10-11, Hawaii County Charter, provides
that any contract, lease or other obligation requiring payment of funds from the appropriations of
a later fiscal year or more than one fiscal year be approved by resolution.
Originally heard on March 19, 2002, this measure was deferred as a representative from the
Police Department was unavailable to attend this meeting. Members of Your Committee also
questioned the completeness of the Request for Proposal (RFP).
Communication No. 545.3, was referred to Your Committee, dated April 4, 2002 from Police
Chief James Correa, transmitting the finalized copy of the RFP, for Provision of Animal Control
Services for the Hawaii County Police Department.
Your Committee heard this resolution again on April 16, 2002, only to be deferred to enable
several Committee members more time to analyze the finalized RFP from the Police Department.
FC REPORT NO. 237
Resolution No. 180-02, Draft 2 was referred to Your Committee, dated May 14, 2002, from
Police Chief James S. Correa, who requested to amend the resolution by allowing the County to
enter into a contract with one or more animal humane organizations.
At Your Committee's meeting of May 14, 2002, Resolution No. 180-02, Draft 3 was introduced
by Council Member Nancy Pisicchio proposing to amend this measure back to it original form
with some minor amendments.
Your Committee, during its discussion of Resolution No. 180-02, Draft 3, made additional
housekeeping amendments.
Your Committee on Finance is in accord with the purpose and intent of Resolution No. 180-02,
Draft 4, and recommends its adoption.
