transmitting, as requested at the Planning Committee's
February 22, 1989 meeting, a listing of the
37 building permits issued for new dwellings and an
additional 14 building permits for additions or
interior alterations issued for the Kona Coast View
Subdivision and/or the Kona Wonder View Subdivision.
Informs, at the request of DWS, their department will
deny a building permit to applicants from either of
the two subdivisions until they can show that they
"will be obtaining water from other acceptable means
other than the Matsumoto water system".

Duane Kanuha dated March 2, 1989, informing they have
received several notifications from the public that
additional archaeological sites and/or resources may
have been discovered during recent construction
activity for site preparation of their subdivision.
States that the conditions set forth in Tentative
Subdivision approval for the Kamani Tree Subdivision
and SMA Use Permit No. 141 (Condition No. 4) require
that should any unanticipated archaeological sites or
remains be uncovered during land preparation
activities, work shall immediately cease and the
Planning Department notified; furthermore, work shall
not resume until clearance is received from their
department.
Informs they are directed to immediately cease all
land preparation activity on the project site, pending
the conclusion of their investigation, and that they
are requested to contact their department as soon as
possible with any information they have in regard to
the uncovering of any additional archaeological sites
and/or resources that had not been detected in the
previously approved archaeological reports and
documents and to also provide them with a status
report on what efforts to comply with the requirements
of the archaeological mitigation measures that have
been accomplished thus far.

completed by their architect and engineer, in full

Works; further, they agree to buildin4 the

dated March 13, 1989, responding to the Planning
Committee's inquiry of February 24, 1989, as to
whether or not the County Council could impose, as
part of the change in State land use boundary, a
condition prohibiting Hasegawa Komuten, Inc., from
seeking future boundary amendments for 15-acre or
smaller parcels of TMK: 7-3-10:27. Concludes that
such a condition, if included in the ordinance
changing the State land use boundary, would be
unenforceable as a means of preventing future changes
in the State land use boundary.
