SUBJECT: Resolution 220-02, Dra 2
Attached for your consideration, please find Resolution 220-02, a Resolution Proposing the
Establishment of a Water System Improvement District for the Kona Coastview and Kona
Wonderview Subdivisions, as amended by Draft 2.
The amended provisions found on page 7 of this resolution address Council findings relating to
the Department of Water Supply "Manager's Report" (Communication No. 652) and the
proposed determination that the Council move forward with a public hearing as provided in
Section 12-28, Hawaii County Code.
These amendments have been prepared by the Legislative Auditor's Office, in close consultation
with bond counsel attorney Andrew Char. They also respond to the letter from DWS Manager
Milton D. Pavao to the Council dated June 18, 2002 requesting that the Council adopt resolution
220-02, as amended, and "set a date fora `combined hearing' to solicit the necessary input and
assent of owners, and thereafter proceed to adopt a bond ordinance to secure the federal
financing to make this long-sought improvement district a reality."
The purpose of these amendments is to expedite a critically needed dedicable water system for
the people of Kona Coastview and Kona Wonderview. Relatedly, these amendments, if adopted,
will kickstart the process of a public hearing and subsequent Council actions to adopt a bond
ordinance in the amount of the proposed $2,776,400 loan portion of the USDA Rural Utilities
Service loan/grant to underwrite the costs of this long-awaited water project.
