HomeMy WebLinkAboutREP PC 054 01/08/2002 2000-2002 REPORT OF THE COMMITTEE ON PLANNING DATE: January 8, 2002 RE: G452 /Bill No. 149 PLACE: Councilroom TIME: 2:07 p.m. Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No. 149, transmitted by Mayor Harry Kim per Communication No. 452, dated December 17, 2001, regarding the change of zone request by Elwin F. Hussey, at Kahua 1st, North Kohala, Hawaii, TMK: 5-9-07: 7, reports as follows: Bill No. 149 amends Ordinance No. 98-87, which amended Ordinance 90-008, which reclassified approximately 28.832 acres of land from an Agricultural (A-20a) to an Agricultural (A-3a) zoned district. The rectangular-shaped subject property, owned in fee by the applicant, is located in the Kohala Estates Subdivision on the southeast side of Ala Kahua Drive approximately 3/4 mile mauka of its intersection with the Akoni Pule Highway. It is part of Unit 1, which was approved by the County in July 1971, consisting of 46 lots. The applicant is proposing to develop an 8-lot subdivision, so is seeking a time extension of five years to secure the Final Subdivision Approval. The Final Subdivision Approval should have been secured by August 27, 2001. On February 13, 1990, Ordinance No. 90-008 was approved by the County Council. On May 13, 1991, aone-year administrative extension of time to Condition B was granted by the Planning Director. On October 15, 1991, tree Planning Director acknowledged the archaeological reconnaissance survey report in compliance with Condition D of Ordinance No. 90-008. On November 1, 1991, the Planning Director acknowledged receipt of subdivision application with preliminary maps and filing fee. On February 10, 1995, tentative Subdivision Approval was secured from the Planning Director. On February 27, 1997, the Planning Director acknowledged receipt of Final Plat maps. On August 27, 1998, Ordinance No. 98-87 amended Ordinance No. 90-008 by granting a time extension of three years to secure Final Subdivision Approval. On September 12, 2001, the Planning Director acknowledged receipt of Request to Amend Condition C of Change of Zone Ordinance No. 98-87. The subject property is situated within the State Land Use Agricultural District. The General Plan Land Use Pattern Allocation Guide (LUPAG) Map designates the area for extensive Agriculture (pasturage and grazing). The subject property is not within the Special Management Area of the County of Hawaii. The North Kohala Community Development Plan Land Use Concept Map recommends this area for Small Scale Agricultural (PUD). PC-54 PC-54 2 January 8, 2002 The Land Study Bureau's Detailed Land Classification System rating for this area is "E" or Very Poor. A soil survey classifies the soil as the Kawaihae series which consists of somewhat excessively drained, extremely stony soils which formed in volcanic ash, with moderate permeability, medium runoff and moderate erosion hazard. The soil is used mostly for pasture, wildlife habitat, and recreation areas. The ALISH system does not classify the soils. Because the property is currently used for grazing, the applicant believes it is unlikely that there are any rare or endangered floral or faunal resources, and archaeological features found within the property. There is no public access to the mountains or the shoreline that run through the property. The property is located within Zone X, an area outside the 500-year flood plain. Surrounding properties to the northeast and northwest are zoned A-3a. The parcel to the southwest is zoned A-20a. Lands to the southeast are zoned A-3a. Surrounding lands are in family residential uses, certain agricultural activities, or are vacant. Access to the property will be from Ala Kehua Drive, which has an 80-foot wide right-of--way and 24-foot wide pavement. Entrance to the property is situated at least 150 feet southwest of the intersection of Ala Kehua Drive and Iliahi Street. Water is available from the Kohala Ranch Water Company's private water system. The applicant entered into an agreement with KRWC in which the latter will commit to not more than 4,800 gallons of water per day. All other essential utilities and services are available to the subject property. Electric utilities are being provided underground. Your Committee did not entertain any discussion on this measure. Your Committee concurs with the Planning Commission and the Planning Director for recommending a favorable consideration for the change of zone request. Your Committee on Planning is in accord with the intent and purpose of Bill No. 149, and recommends it pass first reading.
