VIOHI~REAS, the County of Hawaii is the owner of that certain parcel of land situated at
Hanapai, Pa`ako, Puanui, Waikoloa, Wai`ale`ale and Kapulena, Hamakua, Island of Hawaii, Hawaii,
identified by Tax Map Key No. 3rd/4-fi-05:1, 2, and 3; and
V1d~iER~AS, the State of Hawaii requires aright-of-way for a portion of the identified parcel in
connection with the implementation of the Watershed Plan for the Lower Hamakua Ditch for the
purpose of providing water for farmers in the area; and
UV~lEFt~AS, the State of Hawaii, desires to lease for a term of thirty-five (35) years an interest
in real property described as the Lower Hamakua Ditch Easement No. D-4, more particularly
described in Exhibit "A," attached hereto and made a part hereof, containing an area of 6.03 acres,
together with any improvements located thereon; and
WHEREAS, the Department of Agriculture (DOA) has contracted the services of an
independent appraisal consultant company to conduct an appraisal of the affected portion of the
property to determine its fair market value; and
VIf6~~12~~5, based upon the appraisal report, a portion of which is attached as Exhibit "S," and
made a part hereof, the State of Hawaii has submitted an offer to lease for a term of thirty-five (35)
years an interest in real property described as the Lower Hamakua Ditch Easement No. D-4
containing an area of 6.03 acres, together with any improvements located thereon, for the total sum
of $3,800; and
WHER>sAS, Section 2-111 of the Hawaii County Code states that the Finance Director may be
authorized by resolution of the County Council to grant an easement for a particular purpose, subject
to a reverter back to the County upon termination or abandonment of the specific purpose.
NOW THEREIFORE, ~E IT RES®LVEID BY THE COUNCIL ®F THE C®UNTY ®F HAW~I`I,
that William Takaba, Finance Director of the County of Hawaii, is hereby authorized to execute a
grant of easement in favor of the State of Hawaii, Department of Agriculture, for the implementation
of the Watershed Plan for the Lower Hamakua Ditch.
~E IT FURTHER RESOLVED, that the Clerk of the County of Hawaii transmit copies of this
resolution to William Takaba, Finance Director of the County of Hawaii, and to the State of Hawaii,
Department of Agriculture.
