Choy Family Ltd. Request: Limited Industrial (ML-20) to Industrial-Commercial Mixed Use (MCX-20) Tax Mata Kev: 2-2-32:.95 The Planning Commission, after a duly held public hearing on May 17, 2002, voted to recommend for your approval the proposed legislative bill to change the district classification for approximately 71,483 square feet of land from Limited Industrial (ML-20) to Industrial-Commercial Mixed Use (MCX-20). The property is located at the southern corner of Kanoelehua Avenue and Kuawa Street, Waiakea, South Hilo, Hawaii. The Commission concurs with the following Planning Director's reasons for recommending favorable consideration of the change of zone: The subject property is developed with the Waiakea Square complex which consists of two structures with approximately 27,041 square feet of floor space and 86 parking stalls. The owner seeks to strengthen their marketing position of the existing Waiakea Square by allowing a greater range of uses that would be allowed on the subject property -particularly those relating to retail and commercial activities. The proposed MCX-20 zoning designation would allow for industrial-commercial mixed uses on the subject property. Further, the existing mix of tenants would conform to the MCX-20 zoning and would not be negatively impacted by the zoning change. The existing nine (9) tenants include Fiascos Restaurant/Lounge, Lani's Beauty Salon, Goodwill Industries of Hawaii, Mail With Us, Hyla Hawaii, Big Island Harley Rentals, Koreana Restaurant & Lounge, Rent-A-Center, and Hawaiian Hardwoods. In order to consider an area for any type of zoning designation, the applicable goals, policies and standards of the General Plan must be adequately addressed. It is only through such a comprehensive policy analysis approach that evaluations and decisions Honorable James Y. Arakaki, Chairman and Members of the County Council Page 2 can be made to better time and stage developments to achieve growth determined by the General Plan and related planning documents. The implications of these evaluations and decisions must be also considered as they may have an impact on similar areas in the County, but ultimately, on the future development of the whole island. The proposed change of zone request from aLimited-Industrial (ML-20) to Industrial-Commercial Mixed Use (MCX-20) district classification would further the County's goals of providing an economic environment which allows new or existing businesses to expand and diversify the County's economic base, and thereby also increase the choice of occupations. The proposed request would be consistent with the following goals and policies of the General Plan Economic Element. Economic Element * Provide residents with opportunities to improve their quality of life. * Economic development and improvement shall be in balance with the physical and social environments of the island of Hawaii. * The County of Hawaii shall strive for diversity and stability in its economic system. * The County shall provide an economic environment which allows new, expanded, or improved economic opportunities that are compatible with the County's natural and social environment. * The County of Hawaii shall strive for an economic climate which provides its residents an opportunity for choice of occupation. The applicant's objective recognizes the growing development needs for the region. The applicant seeks to provide the community with further commercial, industrial and community facilities, which take advantage of the site's positive physical and locational attributes. By targeting the project area for commercial and industrial mixed development, the applicant is seeking to meet the urban expansion needs in a manner that is in concert with the long-range community plans as expressed in the County General Plan. The proposed change of zone request would also be consistent with the Land Use Element of the General Plan. Land use is one of the principal focal points of public concern and policy. The Land Use Element provides the primary basis for direct control Honorable James Y. It is also intended to be used as a policy guide for the coordinated growth and development of all sectors of the County. It sets forth goals, policies, standards and courses of action to accommodate growth without congestion, to designate and preserve the lands needed for residential use, commercial and visitor services, industry, agriculture and open space, and to coordinate these uses with the County's service and circulation systems. The overall Land Use goals, policies and standards are set forth to physically plan the lands in the County in the best interest of the island's residents. These state the following under the Land Use Element: * Designate and allocate land uses in appropriate proportions and mix and in keeping with the social, cultural and physical environments of the County. * Zone urban- and rural-types of uses in areas with ease of access to community services and employment centers and with adequate public utilities and facilities. * Allocate appropriate requested zoning in accordance with the existing or projected needs of neighborhood, community, region and County. * The County shall encourage the development and maintenance of communities meeting the needs of its residents in balance with the physical and social environment. * Zoning request shall be reviewed with respect to General Plan designation, district goals, regional plans, State Land Use District, compatibility with adjacent zoned uses, availability of public services and utilities, access and public need. The proposed request would also complement the following goals, policies and course of action of the Commercial Element. * Provide for commercial developments that maximize convenience to users. * Provide commercial developments that complement the overall pattern of transportation and land usage within the island's regions, communities and neighborhoods. * Commercial facilities shall be developed in areas adequately served by necessary services, such as water, utilities, sewers and transportation systems. * Distribution of commercial areas shall be such as to best meet the demands of neighborhood, community and regional needs. Arakaki, Chairman and Members of the County Council Page ~ * The development of commercial facilities should be designed to fit into the locale with minimal intrusion while providing the desired services. Appropriate infrastructure and design concerns shall be incorporated into the review of such developments. The proposed request would also complement the following goals and policies of the Industrial Element: * Designate and allocate industrial areas in appropriate proportions and in keeping with the social, cultural and physical environments of the County. * It shall be the policy of the County to achieve a broader diversification of local industries by providing opportunities for new industries and strengthening existing industries. * Through its zoning powers, the County shall locate industrial areas convenient to transportation facilities, and provide a variety of industrial zoned districts and lot sizes, depending on the needs of the industries and the communities. * Industrial development shall be located in areas adequately served by transportation, utilities and other amenities. Redeveloping or newly developing areas shall be developed in concert with programmed public and privately funded infrastructure to meet the expected needs. * Topography of industrial land shall be reasonably level. * Industrial development shall be conveniently located to its labor resource. * Buffer zones shall be established between industrial and adjacent non compatible uses of land. * The County shall identify sites suitable for future industrial activities. The project area is situated adjacent to existing MCX-20 zoned lands, and is within the vicinity of commercial and industrial uses. The project area is well served by existing infrastructure and roadway systems. The Land Use Pattern Allocation Guide (LUPAG) Map component of the General Plan is a representation of the document's goals and policies to guide the coordinated growth and development of the County. It reflects a graphic depiction of the physical relationship among the various land uses. The LUPAG Map establishes the basic urban and non-urban form for areas within the County. The project area is designated Honorable James Y. Arakaki, Chairman and Members of the County Council Page 5 Industrial. This industrial designation includes uses such as manufacturing and processing, wholesaling, large storage and transportation facilities and light industrial uses. This request is consistent with the Industrial designation on the LL'PAG Map for this area of Hilo. The proposed site would be suitable and allow for the applicant's proposed mixed industrial commercial uses. As the existing zoning in this area is a mix of ML-20, MCX-20 and CN-10, this rezoning reclassification would be a reasonable expansion of commercial -industrial activities and the existing uses in the area. Further, this proposed industrial-commercial mixed development will provide the framework of a concentration of urban activities occurring in an orderly manner and as reflected with the creation of the MCX zoning designation. Adjacent lands to the west are zoned MCX-20 where Hilo Self-Storage and Business Center is located on TMK: 2-2-32:101. Also adjacent to the west on ML-20 zoned lands is Del's Farm Supply. To the south are lands zoned General Industrial (ML-20) and where Jack's Tours was previously located. Across the street along Kuawa Street are lands zoned CN-10 where the Waiakea Kai Shopping Plaza (which includes the Fun Factory, McDonald's Restaurant and other retail establishments) is located,. Thy Word Ministries is located adjacent to the Waiakea Kai shopping Plaza on lands zoned ML-20. Adjacent to the west, also along Kuawa Street is the Morning Dew Lounge on MCX-20 zoned lands. The Hilo Community Development Plan (CDP) adopted in 1975 suggests the retention of industrial zoned lands in this area. The advantage of this area is its location in close proximity to water, air transportation terminals, harbor facilities and the residential population of Hilo, The proposed change of zone would complement the existing industrial and commercial land uses and will provide for an orderly development of the area. The MCX zoning designation is a relatively new zoning district that was created when the Zoning Cody was amended in 1996. In accordance with Section 25-5-130, Hawaii County Zoning Code, this district would allow a mix of industrial and commercial uses. The intent is to provide for areas of diversified businesses and employment opportunities by permitting a broad range of uses, without exposing non-industrial uses to unsafe and unhealthy environments. The project site is situated within close proximity to schools, commercial areas, employment centers and public safety services. Lands located within this -area are zoned CN-10, MCX-20 and ML-20. The project site is located approximately two miles from the Hilo urban center where police, fire and emergency medical services are available. All utilities and services which are essential to accommodate urban development are or will be made available to the project site. Water is available to the site through an Honorable James Y. Arakaki, Chairman and Members of the County Council Page 6 existing 1-1/2 inch water meter. However, according to the Department of Water Supply, 29 more units are being used than the existing meter allows. Therefore, the applicant shall provide the maximum daily water usage as recommended by a registered engineer to be submitted to the Department of Water Supply for review and approval. Further, a backflow preventer shall also be installed in accordance with the Department of Water Supply requirements. A condition shall be included to require all water improvements to be constructed in accordance with the Department of Water Supply requirements within one year from the effective date of the change of zone. The Department of Public Works has informed us that there are outstanding building permits, many of which are permits related to interior renovations proposed by previous tenants. The applicant has stated that they are working with the Building Division to resolve these permits. Further, in the interest of public safety, roadway improvements along the entire frontage of Kuawa Street are being required to provide this development with the appropriate level of road improvements to accommodate an existing MCX development. Final Plan Approval shall be secured from the Planning Department, which shall include a review of any change in parking requirements. Further, due to the fact that the project site has been fully developed, best efforts shall be made to comply with landscaping requirements. Finally, the applicant has informed that existing tenants utilize private waste disposal services. All other utilities and services are available to the subject property. The property has no severe geological or topographical problems which cannot be rectified or which would render the land unusable. The property is located within Zone X, area determined to be outside the 500-year flood plain. All development generated storm run-off shall be disposed of on-site and not allowed onto adjacent properties or roadways. Any further improvements to the property must comply with Chapter 27 of the County Code relating to Flood Hazard Control. Due to the fact that the property has been fully developed, no rare or endangered plants or animals nor any archaeological sites are anticipated to be found on the subject property. Based on the above findings, approval of this change of zone request from Limited Industrial (ML-20) to Industrial-Commercial Mixed Use (MCX-20) zoned district would result in an appropriate land use pattern that will further benefit the general public. The accompanying draft bill to amend Section 25-8-33 (City of Hilo Zone Map), Chapter 25 (Zoning Code) of the Hawaii County Code, is provided for your favorable consideration. Please note that Section 2 of the draft bill has been expanded to include a rationale for supporting conditions which are not normally included in a change of zone request, in particular, the requirement on water and roadway improvements to support the level of services for an industrial-commercial development and to mitigate potential impacts upon public facilities and infrastructure servicing the affected area. Original parking requirements were determined at the time of construction. Current Plan Approval within the Planning Department files indicate that there are 86 parking stalls. According to the existing Zoning Code, retail or commercial uses including MCX zoning would require one parking stall for every 300 square feet of gross floor area. According to the applicant, there is approximately 27,041 square feet of floor area. This floor area would require approximately 90 parking stalls. The applicant would be required to comply with parking requirements, including Amercian Disabilities Act (ADA) requirements. Based on the approximately 90 stalls that would be required, four (4) of those shall be parking for persons with disabilities. Plans submitted with the application indicate 86 parking stalls plus 4 parking stalls for persons with disabilities. 6. Plan Approval/Landscaping: Should the change of zone be approved, Plan Approval review would be required. Further, landscaping requirements, although not originally required during the time that the building was constructed in 1978, are now required through Planning Department Rule 17. A majority of the subject property has been developed with the existing buildings and paved for parking. Landscaping requirements would also be need to be reviewed and complied with in a reasonable way. 7. General Plan Land Use Pattern Allocation Guide (LUPAG) Map: The LUPAG Map designates the project area as Industrial. 11. Hilo Community Development Plan: The CDP and Land Use Concept Map recommends that the area remain in Industrial. The Hilo CDP was adopted by Planning Commission Resolution in 1975. 12. County Zoning: The property is currently zoned Limited Industrial (ML-20a). 13. Industrial-Commercial Mixed District (MCX): The MCX zoning designation is a relatively new zoning district that was created through when the Zoning Code was amended in 1996. In accordance with Section 25-5-130, Hawaii County Zoning Code, this district would allow a mix of industrial and commercial uses. DESCRIPTI£)N OF SUI3,IECT PROPERTY AND SURROUNDING AREA 14. Property: The subject property has a total area of 71,483 square feet and is rectangular shaped. The property is fully developed with an approximately 27, 041-square foot building and paved parking area. The property is a corner lot which has frontage on Kanoelehua Ave. and Kuawa Street. 15. Soil Survey: The soils in the project area are classified as Keaukaha (rKF'D), 6 to 20%, which consists ofwell-drained, thin organic soils overlying pahoehoe lava bedrock. Runoff is medium and the erosion hazard is slight. 16. Land Study Bureau's Detailed Land Classification System: Urban area. 17. ALISII: Existing Urban development. 18. FIRM: Zone "X", an area determined to be outside the 500-year flood plain. 19. Floral/Fauna and Arclgaeological Resources: Since the property has been fully developed, the likelihood of any endangered flora and fauna or archaeological features are remote. -3- 20. Valued Cultural Resources: The property has been fully developed, and there are no known valued cultural, historical or native resources nor has any traditional and customary native Hawaiian rights been practiced in the area. 21. Pulblic Access: There is no public access to the mountains or the shoreline that traverses through the property. 22. Surrounding Zoning/Land Uses: The property is within an area that has been extensively developed for commercial and industrial uses. PUBLIC UTILITIES Al®1D SERVICES 24. Access: Existing access is from Kuawa Street on the north and from Kanoelehua Ave. on the south end of the property. Kuawa Street has an approximately 60-foot right-of--way and a pavement width of approximately 36 feet. Kanoelehua Ave. is a six-lane divided highway with a 120-footright-of--way. 25. V6~atcr: Water is currently available from an existing 1-1/2 inch meter. According to the Department of Water Supply, the average daily water use is 54 units or 29 units more than the existing meter allows. The average daily water use for the last two years is 54 units or 29 units more that the existing 1 %2 -inch meter is allowed and the meter has been replaced two times since 1990. For these two reasons, we ask that the anticipated maximum daily water usage as recommended by a registered engineer be submitted to the Department for review and approval. The Department reserves the right to make a final determination. In addition, as a condition of approval, the Department of Water Supply will require the installation of a backflow preventer (reduced pressure type) by a licensed contractor on the applicant's property just after the meter. The installation and assembly of the backflow preventer must be inspected and approved by the Department. The backflow preventer shall be operated and maintained by the customer.
