Comm. 119: REDESIGNATION OF STATE LAND USES TO PROTECT AREAS ABOVE
AND ADJOINING KEALAKEKUA BAY
Copy of letter to Representative Virginia Isbell from
Harold S. Masumoto, Director, Office of State Planning,
dated January 13, 1989, informing that their office
will be conducting a comprehensive five-year review of
the State Land Use District Boundary, including lands
affected by proposed change #106 of the Hawaii County
General Plan LUPAG map at Kealakekua Bay. Also informs
that current law requires that the five-year boundary
review considers County designations, therefore, if the
County's LUPAG map identifies the subject parcel as
agriculture, serious consideration will be given to
changing the State's designation to conform.
Comm. 120: Copy of letter to Christopher Norrie from Harold S.
Masumoto, Director, Office of State Planning, dated
January 13, 1989, informing of the comprehensive
five-year review their office will be conducting on the
State Land Use District Boundary, which includes lands
he identified in the area above Kealakekua Bay. States
the five-year District Boundary Review will provide the
opportunity to appropriately evaluate land uses which
are in the best interests of the State and which are
consistent with the long-term planning goals for the
County of Hawaii. Informs the State Land Evaluation
and Site Assessment (LESA) effort will provide for the
continuing statewide identification of important
agricultural lands and assures that the historic Hawaii
County Kona Coffee Belt will be included in the
assessment.

Comm. 122: REZONING CONllITIONS
From Acting Corporation Counsel Patricia K. O'Toole
dated January 6, 1989, responding to an inquiry as to
whether the Council may, as a condition to rezoning,
impose requirements that developers carry out certain
acts within the Special Management Area. States the
Council may impose conditions which affect land which
lies within the Special Management Area if those
conditions are: 1) based on the purpose of promoting
the health, safety, morals, or general welfare of the
community and are consistent with the County's General
Plan; and 2) consistent with and not interfering with
Special Management Area Permits that have been issued.
Comm. 123: APPLICATION OF HOME CAPITAL DEVELOPMENT GROUP TO AMEND
SMA PERMIT N0. 132; TMK: 7-6-16:01

Neighborhood Action Group, dated January 16, 1989,
regarding Home Capital Development Group's proposed
amendments to SMA Permit No. 132. Transmits copy of a
petition signed by 235 residents of their organization
who are opposed to the proposal.
Comm. 150: From R. Ben Tsukazaki of Menezes, Tsukazaki & Yeh,
dated January 25, 1989, on behalf of Home Capital
Development Group, addressing the comments in
Jerry Rothstein's letter of January 16, 1989 and
providing what they believe to be a complete picture of
the facts surrounding the application to amend SMA
Permit No. 132.

Places Review Board, State Department of Land and
Natural Resources, dated January 17, 1989, informing
that at their meeting of January 14, 1989, a decision
was made to place the following properties on the
Hawaii Register of Historic Places and to recommend to
the State Historic Preservation Officer that he
nominate the properties for placement on the National
Register of Historic Places:

the Guidelines & Standards for Public Access to the
Shoreline, County of Hawaii, which was prepared in 1981.
