Thank you for your letter of June 21, 2002, providing an annual progress report in
accordance with Condition C of Ordinance No. 88-93 and Condition No. 4 of SMA Use
Permit No. 269. This is also to confirm receipt of a copy of the report from International
Archaeological Research Institute, Inc. dated April 12, 2002, which provided status on
the archaeological fieldwork and draft inventory survey report.
Change of Zone Ordinance No. 88-93 rezoned 111.75 acres of land from Unplanned and
Agricultural (Sa) to Residential-Agricultural (RA-2a). The intent of the applicant was to
develop a 37-lot subdivision. SMA Use Permit 1Vo. 269 was granted by the Planning
Commission ±o allow development of the 37-lot subdivision.
Subsequent to the application fora 37-lot subdivision (SUB 90-5), a new 2-lot
subdivision (SUB 624) was approved on March 9, 1993. As the required 60-foot wide
structural setback was included on the final plat map, this 2-lot subdivision was
approved. Please note, however, that the pending 37-lot subdivision must also comply
with this required 60-foot wide structural setback.

Below we provide you with ouj.- findings regarding compliance with Ordinance No. 88-93
and SMA Use Permit No. 269.
Ordinance No 88-93
Condition B: No tentative approval has been granted for the 37-lot Subdivision
Application 90-5, and the application has been held in abeyance since
1991. Condition No. 3 of SMA No. 269 must be complied with before
tentative subdivision approval can be granted.
Condition C: Compliance with this condition is ongoing.
Condition D: Written documentation from the Department of Public Works that the
proposed drainage system for the 37-lot subdivision has met with their
approval must be submitted to provide evidence of compliance with this
condition.
Condition E: Please note that our October 22, 2001 response requires clarification. The
compliance statement should refer only to the approved 2-lot subdivision
(SUB 6254). Compliance with the 60-foot wide structural setback for the
37-lot subdivision is also required and this must be delineated on the
preliminary plat map.
Condition F: This condition is still currently not relevant.
Condition G: Compliance with this condition has already been acknowledged by our
letter dated December 1, 2000.
Condition I: Subdivision Application 90-5 has been in abeyance since 1991. If you
choose to pursue approval of Subdivision Application 90-5, we will
require that you provide an updated preliminary plat map to include the
required 60-foot wide structural setback. You will also need to
demonstrate compliance with public access requirements pursuant to
Hawaii County Code, Chapter 34. Before requesting final subdivision
approval, you will need to demonstrate compliance with all conditions of
Ordinance No. 88-93 and SMA Use Permit No. 269.

SMA Use Permit No. 269
Condition 3: Please provide written documentation from the State Historic Preservation
Division that "A Scope-of--Work and Research Design for Archaeological
Investigations at Captain Cook Ranch LLC, Ahupua'a of Kealakekua,
Kona District, Island of Hawaii" by M. J. Tomonari-Tuggle dated October
2001 has met with their approval. In addition, the Planning Director
would also have to approve this document. Although verification from the
State Historic Preservation Division would confirm that Condition 3a has
been complied with, Conditions 3 b-d must still be complied with.
