RESOLUTION AUTHORIZING THE SALE SY NEGOTIATION OF THE
COUNTY OF HAWAII OFFICE SPACES WITHIN THE HILO LAGOON
CENTRE, IN ADDITION TO TI~~ AUTHORIZATION PROVIDED IN
RESOLUTION 167-02 (RESOLUTION AUTHORIZING THE FINANCE
DIRECTOR OF THE COUNTY OF HAWAII TO DISPOSE OF COUNTY
OFFICE SPACES WITHIN THE HILO LAGOON CENTRE.)
WHEREAS, the County is the owner of office spaces within the Hilo
Lagoon Centre, housing the offices of the Corporation Counsel, Aging, .and
Department of Civil Service, more particularly described as follows:

WHEREAS, the Council of the County of Hawaii, via Resolution 167-02,
adopted on February 6, 2002, authorized the Finance Director or his authorized
representative to "dispose of the above-mentioned property by the methods
provided in sections 2-112 (disposition by auction) and 2-113 (sale or Eease by
sealed bids), Hawaii County Code, and under such other conditions as may be
advisable;" and
WHEREAS, the Finance Director has established a "Land Management
Committee," composed of County personnel with expertise or interest in the
County's management of its real property resources, for the purpose of reviewing
County land management issues and making recommendations to the Finance
Director; and
WHEREAS, the Council of the County of Hawaii finds that the public
interest demands that the sale of the County properties at the Hilo Lagoon
Centre obtain the highest value and best return potential in view of the
circumstances surrounding the properties, which may best be achieved through a
negotiated sale; and
WHEREAS, the Council of the County of Hawaii also finds that there may
be public purpose in the exchango of County property and private property, in
that acquiring certain lands would fulfill present and future County needs.
WHEREAS, the members of the Land Management Committee and
Finance Director believe that disposition by negotiation of the above County
properties may obtain the highest value and return value, and thereby be in the
best interests of the County; and
WHEREAS, the members of the Land Management Committee and
Finance Director have been contacted by private land owners who may be
interested in an exchange of rea4 property, and who are proposing an exchange
of County lands for private property, which may result in the County acquiring
properties it may need to fulfill a public purpose.
NOW, THEREFORE, SE IT RESOLVED SY THE COUNCIL OF THE
COUNTY OF HAWAII that it finds the public interest demands the sale of the
County properties at the Hilo Lagoon Centre be by negotiation because it will
obtain the highest value and best return potential in view of the circumstances
surrounding the properties.
SE IT FURTHER RESOLVED that, pursuant to Section 2-114(a), Hawaii
County Code, it approves of and directs the Finance Director or his authorized
representative to proceed with the sale by negotiation, so long as the public
interest demands it, of so much as may be necessary of the County properties at
the Hilo Lagoon Centre which are set forth in Resolution 162-02.
SE IT FURTHER RESOLVED that, pursuant to Section 2-115, Hawaii
County Code, it approves of and directs the Finance Director or his authorized
representative proceed with the exchange of County owned property at the Hilo
Lagoon Centre, so long as there is a public purpose in such exchange.
BE IT FURTHER RESOLVED that this authorization to dispose of property
through negotiation shall be in addition to the authorization given in Resolution
16~-02 in order to afford the maximum administrative flexibility for the disposition
of the subject properties in the best interests of the public.
BE IT FINALLY RESOLVED that copies of this resolution be transmitted to
the Honorable Harry Kim, Mayor of the County of Hawaii, and the Director of
Finance.
