AN ORDINANCE AMENDING CHAPTER 24, OF THE HAWAII COUNTY CODE 1983
(1995 EDITION), RELATING TO VEHICLES AND TRAFFIC.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. The Police Department has noticed an increase in problems on certain
dead-end streets (typically stub outs) which serve no immediate purpose. In order to prevent
problems with loitering, littering, drinking, and drug use, the Police Department would like
authority to block off or barricade these stub outs. This action would be done with notice to
adjacent landowners and is temporary in nature so that the road may still be used in the future.
SECTION 2. Chapter 24, article 7, division 3, section 24-153.3, of the Hawaii County
Code 1983 (1995 edition), is amended to read as follows:
Secti®n 24-153.3. [Peranits.] Street closure.
~ No person shall block, close, restrict or impede the traffic on any street, highway,
[trafficway, causeway] or public right-of--way, for any length of time for parades,
processions or for any festive, religious, civic or other special activity except in
accordance with a permit issued by the chief of police or his authorized
representative and such other regulations as are set forth herein. Such permits
issued shall be immediately revoked at any time by the chief of police or his
authorized representative when there is reason to believe that the activity is
endangering any person, vehicle or property on or off such street, highway,
trafficway, causeway or public right-of--way.
The chief of police in conjunction with the director of public works, may,
without permits barricade stub outs, dead-ends, and other road terminus which
do not affect the flo«~ of traffic, with notice to ad~at cent property owners to
prevent access when deemed necessary to prevent loitering, littering and other
related problems.
SECTION 3. Material to be repealed is bracketed. New material is underscored. In
printing this ordinance, the brackets, bracketed material and underscoring need not be included.

SECTION 4. If any provision of this ordinance, or the application thereof to any person
of circumstance, is held invalid, such invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid provision or application, and to
this end, the provisions of this ordinance are declared to be severable.
SECTION 5. This ordinance shall take effect upon its approval.
