AN ORDINANCE AMENDING CHAPTER 15, ARTICLE 7, OF THE HAWAII
COUNTY CODE 1983 (1995 EDITION), RELATING TO VETERANS ADVISORY
COMMITTEE ADDING MILITARY ORDER OF THE PURPLE HEART AND DELETING
SUBSECTION (g).
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. The Military Order of the Purple Heart, Hilo Chapter #731 in June 2002
received its recognition charter to Congressionally chartered Military Order of the Purple Heart
of the United States of America, Inc. Hawaii County Council in recognition of this newly
chartered veterans organization desires to add the Military Order of the Purple Heart as a member
to the Veterans Advisory Committee. The County Council further finds that subsection (g) of
Section 15-62 is no longer necessary and may confuse the Council's intent. Therefore, the
County Council deletes subsection (g) of Section 15-62.
SECTION 2. Chapter 15, article 7 of the Hawaii County Code 1983 (1995 edition), is
amended to read as follows:
Section 15-61. Organization.
There shall be a committee composed of [fifteen] sixteen members, who shall be
appointed by the mayor and confirmed by the council. Any member of the committee
may be removed by the mayor with the approval of the council.
Section 15-62. Membership and tenure.
(a) The members shall serve staggered terms of five years.
(b) The membership of the committee shall include one representative each from the
American Legion, Big Island National Guard Retirees Association, Big Island Retired
Military Association, Club 100, Disabled American Veterans, Hawaii Island Veterans
Memorial, Inc., 442nd Veterans Association, Hilo Interpreters Club, Hawaii Island
Women Veterans Association, Veterans of Foreign Wars, [and] the Veterans of the
Vietnam War and the Military Order of the Purple Heart Hilo Chapter # 731.
(c) Initially, two members shall be appointed for a term of one year, two members shall
be appointed for a term of two years, three members shall be appointed for a term of three
years, three members shall be appointed for a term of four years, and three members shall
be appointed for a term of five years.
(d) Any vacancy on the committee shall be filled for the remainder of the unexpired
term, but members whose terms have expired may continue to serve until their successors
have been appointed and confirmed.
(e) Members shall be eligible to succeed themselves for an additional term, provided that
no member shall serve on the committee for more than two consecutive terms.
(f) The Hawaii Island veterans services counselor of the office of veterans services
(department of defense of the State of Hawaii) and the director of the department of
parks and recreation, or their designates, shall be ex-officio members of the committee.
[(g) The first term of the representative from the Eig Island National Guard Retirees
Association shall expire on December 31, 1993. The first term of the representative from
the Special Forces Association shall expire on December 31, 1992. Thereafter, successors
to these representatives shall be appointed for a term of five years].
SECTION 3. Material to be repealed is bracketed. New material is underscored. In
printing this ordinance, the brackets, bracketed material and underscoring need not be included.
SECTION 4. If any provision of this ordinance, or the application thereof to any person
or circumstance, is held invalid, such invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid provision or application, and to
this end, the provisions of this ordinance are declared to be severable.

SECTION 5. This ordinance shall take effect upon its approval.
