Attached for your favorable consideration is proposed Bill No. 243, Draft 3, which includes the
following amendments as discussed at the July 30, 2002 Planning Committee meeting:
1. SECTION 2, 2(B). Restores language which was deleted in Draft 2. "In this case,
there is a desire to protect the forest and wat~r~hed areas, to control the overall density of
the area to preserve the present ambience of the Kaloko Mauka Subdivision and to
mitigate concerns over the Kaloko Drive/Mamal~hoa
Hi~hwav intersection and the use
of the subdivision roads."
2. New Condition C. Inserts language which was not included in the original bill.
`The required water commitment~avment shall be submitted to th~De~artment of
Water Supply in accordance with its "Water Commitment Guidelines Policy" within
ninety (90) da~from the effective date of this ordinance.'
3. Renumbers remaining conditions.
4. Condition D [nserts the phrase "from the property line" in the first sentence
so it reads: `a 60-foot wide "forest reserve easement" along Kaloko Drive frontage om
the plonerty line......'
5. Condition E.
a. Replaces Condition "C" with Condition "D" throughout the entire paragraph.
b. Deletes the word "or" from the second sentence.
6. Condition I. Deletes the first word "An" and replaces it with "No".
Inserts the phrase "right-of--way shall exceed 20 feet in width, and all" so the sentence
reads: "[An] No interior private subdivision road right-of-wav
shall exceed 20 feet in
width, and all shall be constructed...."
7. Condition N. ~
a. Replaces Condition "M" with Condition "N" throughout the paragraph. ~
b. Deletes from the second paragraph the sentences " In lieu of paying the fair ~ ~
share contribution, the applicants may prepare studies and designs, construct and ~ ~
contribute land, improvements/facilities related to parks and recreation, fire, ~ ~ ~
police, solid waste disposal facilities, and roads within the region impacted by
the proposed development, subject to the approval of the Director." ~ ~
8. Condition O. Replaces Condition "M" with Condition "N" in the first sentence.
