Your Committee on Planning, to which was referred Bill No. 240, transmitted by Mayor Harry
Kim, per Communication No. 683, dated June 18, 2002, regarding the change of zone request by
1~eatrice C. Choy >Family Ltd., at Waiakea, South Hilo, Hawaii, TMK: 2-2-32:95, reports as
follows:
Bill No. 240 amends Section 25-8-33 (City of Hilo Zone Map), Article 8, Chapter 25 (Zoning
Code), by changing the district classification for approximately 71,483 square feet of land from a
Limited Industrial (ML-20) to an Industrial-Commercial Mixed (MCX-20) zoned district.
The rectangular shaped lot, owned in fee by the applicant, lies at the southern corner of
Kanoelehua Avenue and Kuawa Street. The applicant is seeking the zoning change to strengthen
the marketing position of the existing Waiakea Square complex by allowing a greater range of
uses for the subject property, especially the retail and commercial activities. The property is fully
developed and consists of two structures with approximately 27,041 square feet of floor space
and 86 parking stalls.
The MCX-20 designation would not impose any negative impacts on the existing tenants:
Fiascos Restaurant/Lounge, Lani's Beauty Salon, Goodwill Industries of Hawaii, Mail With Us,
Hyla Hawaii. Big Island Harley Rentals, Koreans Restaurant & Lounge, Rent-A-Center, and
Hawaiian Hardwoods. The MCX designation, which allows a mix of industrial and commercial
uses, was created in 1996 with the Zoning Code amendment, and is intended to provide areas of
diversified businesses and employment opportunities by permitting a broad range of uses without
exposing non-industrial uses to unsafe and unhealthy environments.
The property is not situated within the Special Management Area.
The soils in the project area are classified as Keaukaha, which consists of well-drained, thin
organic soils overlying pahoehoe lava bedrock with medium runoff and slight erosion hazard.
The State Land Use designation is Urban District. The Land Study Bureau's Detailed Land
Classification System designates the area as Urban . The ALISH designation is Existing Urban
development. The LUPAG map designates the project area as Industrial. The Hilo Community
Development Plan and Land Use Concept Map recommends the area for Industrial use.
The subject parcel lies in Zone "X" which is an area determined to be outside the 500-year flood
plain.

The likelihood of any endangered flora and fauna or archaeological features are remote since the
property has been fully developed.
Surrounding properties have been extensively developed for commercial and industrial uses.
Adjacent lands to the west are zoned MCX-20 (Hilo Self Storage and Business Center), and ML-
20 (Del's Farm Supply). Lands to the south are zoned General Industrial ML-20 (Jack's Tours).
Directly across Kuawa Street are lands zoned CN-10 (Waiakea Kai Shopping Plaza). Adjacent
to the Waiakea Kai Shopping Plaza is the Thy Word Ministries on land zoned ML-20. Adjacent
to the west, along Kuawa Street is the Morning Dew Lounge on lands zoned MCX-20.
Existing access is from Kuawa Street (which has a 60-foot right-of--way and a pavement width of
approximately 36 feet) on the north and from Kanoelehua Avenue (a six-lane divided highway
with a 120 foot right-of--way) on the south end of the property.
Water is currently available from an existing 1 `/2 inch meter. The Department of Water Supply
states that the water usage exceeds the permitted amount by 29 units; therefore, the water usage
level needs to be monitored and reports need to be submitted to the Department of Water Supply
for review and approval. In accordance with the Department of Water Supply requirements, the
applicant will also be required to install a backflow preventer.
Reports from the Department of Public Works indicate there are outstanding building permits for
interior renovations proposed by previous tenants. The applicant has indicated they are working
together with the Building Division to resolve these permits.
The property is currently served by the County sewer system, and tenants utilize private waste
disposal services. All other services and utilities are available to the subject parcel.
Your Committee did not entertain any discussion on this measure.
Your Committee finds that this zoning request is in compliance with the County's General Plan,
and concurs with the Planning Commission and the Planning Director for recommending a
favorable consideration for the change of zone request.
Your Committee also concurs with the Planning Director and the Planning Commission in
finding that the conditions included in the Bill No. 240, "are (1) necessary to prevent
circumstances which may be adverse to the public health, safety and welfare; and (2) reasonably
conceived to fulfill needs directly emanating from the land use proposed with respect to (A)
protection of the public from the potentially deleterious effects of the proposed use, or (B)
fulfillment of the need for public service demands created by the proposed use. In this case,
conditions for water and roadway improvements are imposed to support the level of services for
an industrial-commercial development and to mitigate potential impacts upon public facilities
and infrastructure servicing the affected area.

Your Committee on Planning is in accord with the intent and purpose of Bill No. 240, and
recommends it pass first reading.
