Attached for your favorable consideration is proposed Bill No. 243, Draft 4, which includes the
following amendments as discussed at today's Council meeting:
1. Condition N. Second sentence. Deletes the phrase "prior to Final Subdivision Approval
for any portion of the subject property or its increments." and replaces it with "within
ninety days of the effective date of this ordinance."
2. Condition N. Second paragraph. Retains the first sentence and deletes the rest of the
paragraph. "For purposes of administering Condition N, the fair market value of land
contributed or the cost of any improvements required or made in lieu of the fair share
contribution shall be subject to the review and approval of the Director, upon
consultation with the appropriate agencies."
3. Condition N. The third paragraph is amended to read as follows:
"Upon approval of the fair share contributions [or in lieu contributions by the Director],
the Director shall submit a final report to the Council for its information that identifies
the specific approved fair share [and/or in lieu] contributions, as allocated, and further
implementation requirements."
4. Deletes Condition O in its entirety.
5. Renumbers remaining conditions.
