(2 years is pretty good considering it took the county 22 years to conform to Chapter 34 public access!!!!)...... There is nothing in this bill gat is in conflict with state law.......... .ako'o was able in February of this year (latter enclosed} to provide comments on these roposed amendments. There has been ample time and notification given to the general ubiic for comments. VHY IS T~iIS MERTING RING ASKED FOR?? special interest individuals who make a living doing the legal work of CPR's have called for pis public meeting. These special) interest people should not be able to hold hostage the assage of these bills because of there selfish private interests.......the bill is not denying CPR .....they can still make a living representing potential CPR customers RUT in accordance pith existing underlying county zoning lain ~ Simple, bill 220 is closing LOOPHOLES that have circumvented zoning and .~bdivision codes we keep developing & developing and subdividing & ~bdividing..... without requiring the necessary infrastructure and services .................too many eople have ABUSED Tt~E CPR LAW over the years........ Chris Yuen, Director Planning Department County of Hawaii 2~ Aupuni St. Hilo, HI 9b720 Subject: Planning Director Initiated Amendment to Chapter 23 (Subdivision Code) Condominium Property Regimes Dear Mr. Yuen, Kamakani O Kohala Ohana (Kako'o) is a 501 (c)(3), non-profit organization with an active membership of 300 families based in North Kohala. We support your efforts to have Condominium Property Regimes (CPR's) comply ~ti-ith the requirements of Chapter 23, Subdivisions, as it relates to providing proper infrastructure. The majority of land in North Kohala is zoned Agricultural-20 acres (A-20a) and most CPR's in North Kohala have involved lots that could not legally be subdivided because 20 acres is already the smallest legal size parcel established by the zoning. Circumventing these zoning codes via CPR is a direct result of supply & demand economics. There is an insufficient inventory of affordable land due to expensive real estate values in this area. This is due in part to its close proximity to the hotel/visitor industry in South Kohala. The demand for labor is supplied by North Kohala residents, (employed directly or indirectly to service this hotel/visitor industry) many of whom desire but cannot afford land and the demand for this same land by the ever growing affluent population whom can afford the inflated prices and therefore drive up land values. Kako'o acknowledges the need for smaller "affordable" land parcels in the North Kohala District but also understands that Condominium Property Regimes (CPR's} as currently administrated by the State Real Estate commission is not the appropriate answer to the affordable land/housing issue facing the County Planning Department. Existing zoning codes may need to be changed to meet ever growing land demands but that is another issue beyond the scope of the proposed amendment. The proposed amendment will insure that when any future land in North Kohala is subdivided using a Condominium Property Regime, the newly created lots are adequately served by roads and other infrastructure, and that drainage and flooding issues are properly addressed.
