I speak against this ordinance for a simple reason. Liability) 'Have you received counsel from our Corporation Counsel that these measures will not be a taking? I am reminded painfully of hearings held on Oahu in the late 80's in an issue that has come to be known as Save Sandy Beach Initiative. As a real estate professional active as a volunteer I expressed concern to the city council members of Honolulu City council. Today the current council of CSC Honolulu is in negotiations with that land owner (Bishop restate) for the down zoning that occurred. The taking has been confirmed and upheld by the supreme court. The settlement will be in the millions of dollars in cash and land value trades. I see the benefits that the form of CPR ownership brings to the cost of housing. It does enable affordable housing. I see the problems that CPR ownership brings when used as a zoning tool. Health and safety are paramount in my mind as I help my clients find a home. integrity of a development is critical for quality of lifestyle and confdence in resale values. I was present on ®ahu at the state legislature for almost all of the hearings that were held to include the counties in the process for the CPRing of property (Act 251). The point that is being missed here is that CPR is a form of ownership. it is not a zoning tool. I should think that the number of citizens that have resorted to CPR for a means of affordable housing would point out the true weakness. That weakness is the need to restructure and bring into ~e 21~ century our methods of land planning and subdivision. Not an action that will likely result in a taking and thus embroil the county in litigation. The county of Hawaii does not have large sources of revenue. We have a huge, complicated lawsuit looming over the citizens already. loo we really need to add a takings lawsuit to the agenda? Please think carefully about the greater good for the greater number of Hawaii County's citizens. Please send this back to the drawing board along with the subdivision code. My fellow members of the H1~3R and I will continue to spend our volunteer hours to accomplish this end. Thank you for the opportunity to testify in opposition to this measure.
