FOUNDED 18 9 2 ~t~ ~________~l~?._ B ,r'~ t~ County Counc+I August 27, 2002 I°Iawaii County Council Dear Council members: As chairman of the Moku Loa group of the Sierra Club I am speaking on behalf of our more than 700 members on the dig Island. We would like to state our support of the revisions to the CPIZ ordinance that are proposed by Director Yuen. Condominium property regime (CPIs) was aceated to allow for shared community resources such as walls and common areas in condominium apartment projects. However some individuals have used CPRs to bypass the intent of our zoning laws. An example of a misuse of CPIZ is the subdivision of Ag-20 Iots. A-20 zoning was created to protect the rural character of much of our land. liy limiting lot size to a m;,~;muxn of 20 acres and only allowing one house on that lot a low housing density is assured. Much of our former cane land in the Hamakua region is zoned A-20 and most residents are very concerned that the region not lose it's rural character. Certain developers have used the CPIZ process to subdivide these A-201ots into smaller Iots that entirely defeat the point and intent of A-20 zoning. Not only is the housing density increased, but also the level of infrastructure such as roads and public services are stressed by these additional residents. Chris Yuen, the Director of Planning, has created a proactive solution to this subversion of our zoning codes. The state legislature passed a law, Act 251 to deal with this problem but we feel that steps should be taken to codify these changes here on the Iiig Island. The proposed changes are found in bill numbers 213 and 220. These additions to the county code Section 23A numbers 1- 23 will help to close the loopholes that have been exploited by a few for their pars®nal gain.
