Dear Ms. Leithead-Todd:
~1Vith a goal of providing infrastructure coincident with the sale of CPR single-family dwelling
units, Bi11220 is drafted to narrowly focus on quasi-subdivision of land into "units" which
include, or may include, asingle-family dwelling unit, in the applicable zoning districts.
Other allowed uses, not involving dwellings, in said zoning districts and which may be subjected
to H.R.S. sec. 514A include agricultural parks, aquaculture, memorial parks, yacht harbors,
boating facilities (boat parking), stables/equestrian facilities, and others, some of which may only
be economically viable through the application of Chapter 514A. Such projects could provide
employment, expand consumer choice, enhance quality of life, and diversify the economy.
However, absent a subdividable parcel, such a CPR project would not be merely regulated by
Bill 220, it would be summarily prohibited by the present form of Bi11220, thereby inviting
attack under 514A-45, which proscribes conflicting county legislation.
To reduce unintended consequences, and to allow the bill to move forward quickly in its present
form, application of the bill should be confined to its stated and obvious purpose. This may be
accomplished by inserting the following clarification.
Section 23A-3. Applicability. Sections 23A-1 to 23A-20 apply only to condominium property
regimes in the RS, RA, A, FA, lA, and APD zoning districts, [and to no other zoning districts.]
