Your Committee on Finance, to which was referred Resolution No. 227-02. reports as follows:
Resolution No. 227-02, transmitted by Corporation Counsel Lincoln S.T. nshida via
Communication No. 485.x, dated ,iuly 18, 2002, authorizes the sale by negotiation of the County
of Hawaii offiice spaces within the Hilo Lagoon Cenh~e.
On February 6, 2002, the Council adopted Resolution No. 1 fi7-02. which authorized the I~ inancc
Director or his authorized representative to "dispose of county office spaces within the Hilo
Lagoon Centre by the methods provided in Sections ?-1 12 (disposition by auction) and ?-1 12
(sale or lease by sealed bids), Hawaii County Code, and under such other conditions as may be
advisable"'.
In addition to Resolution No. 167-02, Resolution No. 227-02 proposes the sale by negotiation of~
the cow~ty office spaces within the Hilo Lagoon Centre in order to obtain the highest value and
best return potential in view of the circumstances surrounding the properties.
The Finance Director has established a 'Land Management Committee for the purpose of
reviewing County land management issues and making recommendatio?1s to the Finance
Director. Private landowners have contacted the Land Management Committee and the Finance
Director and are interested in proposing an exchange of county land for private property.
Pursuant to Section 2-1 14(a), Hawaii County Code. real property may be sold or leased through
negotiation upon a tinding by the council that the public interest demands it.
Also pursuant to Section ?-1 15. Hawaii County Code. no e~:change of real property for private
property shall be made except for public purposes.
The council finds the puhlic interest demands the sale o(~county properties at the Hilo Lagoon
Centre by negotiation because it ~~°ill obtain the highest value and best return potential in vicw~ of
the circumstances surrounding the property.

Some members of Your Committee felt that the sale by negotiation would not bring the hest and
highest value for the aforementioned property.
For informational purposes. Mr. Tyler voted kanalua twice.
Your Committee on Finance is in accord with the purpose and intent of~ Resolution Nu. ??7-0?
and recommends its adoption.
