SUBJECT: Donation of Land
At its next meeting on September 10, 2002, the Finance Committee will be discussing a donation of land
by Tetsuo and Toshie Miyamoto. We hope that this discussion will provide guidance on the procedure
and policy for accepting or rejecting donated lands, especially those lands inundated by lava.
On August 21, 2002, a meeting to discuss a procedure for donated lands was held with Finance Director
William Takaba, Deputy Finance Director Nancy Crawford, Assistant Corporation Counsel Gerald
Takase, Deputy Corporation Counsel Ivan Torigoe, Property Management Specialist Stanley Iwamoto,
Budget Administrator Gary Takamura, Legislative Auditor Connie Kiriu and me. While we were able
to make headway on several procedural matters, there were unanswered questions that could only be
answered after further discussion with the mayor or by the council:
1. Does the administration have a position on the donation of lava lands? (That position
may be stated at the next Committee meeting.)
2. If the administration does not want to accept lava lands, would the request be sent to the
county council who has the final authority to accept donations?
3. Does the council maintain its position ofnon-acceptance of lava lands that started in
1996?
4. If so, should it be articulated in a resolution or other form of communication?
5. What is the administration's position on forgiving or deferring real property taxes on lava

of roads, drainageways, parks, etc.) be established in the code?
BACKGROUND
Beginning in 1993, the County began to accept property from owners of lava land who had no
use for their property and did not want to pay the corresponding minimum taxes. In 1996,
concerned were expressed by Council Members over the lack of site inspections, the possibility
of hazardous waste and exposure to liability.
Since that time, requests have been held in abeyance or filed (see attached list). More recently,
the administration and individual council members have been receiving letters from landowners
who wish to donate their land to the county because of lava inundation or because they do not
see cost-benefit to paying their taxes. These offers may be occurring snore frequently with the
increases in the minimum tax and tax rates.
We ask for guidance because of the need for public clarity.
