Your Committee on Planning, to which was referred Bill No. 224, transmitted by Mayor Harry
Kim, per Communication No. 642, dated May 20, 2002, regarding the change of zone request by
I~aowaii Preparatory Acadepny, at Ouli, South Kohala, Hawaii TMK: 6-2-7: 2, reports as
follows:
Bill No. 224 amends Section 25-8-7 (North and South Kohala Districts Zone Map), Article 8,
Chapter 25 (Zoning Code) of the Hawaii County Code, by changing the district classification for
approximately 5.0 acres of land from an Agricultural (A-Sa) to a Residential and Agricultural
(RA-2a) zoned district.
The rectangular-shaped subject property, owned in fee by the applicant, is located in the Kamuela
Plantation Subdivision, along the south side of Kawaihae Road bordering Keanuiomano Stream
east of the Kanehoa Subdivision. The subject property is one often lots created on April 30,
1981 as the Kamuela Plantation (Subdivision No. 4627).
The applicant proposes to subdivide the subject property into two lots, each with a minimum of 2
acres. There are no immediate plans to improve the lots at this time.
On October 23, 1996, a State Land Use Boundary Amendment was made from Agricultural to
Rural. The General Plan Land Use Pattern Allocation Guide (LUPAG) Map classification is
Extensive Agricultural, which allows for pasturage and range lands.
The subject property and surrounding areas were previously zoned Unplanned; however, with the
adoption of the Zoning Code on December 7, 1996, all Unplanned districts were reclassified to
Agricultural-5 acre (A-Sa).
Ohana dwelling permits have been granted for 41ots in Kamuela Plantation, 16 lots in Kanehoa
Subdivision and 12 lots in Anekona Estates Subdivision. Condominium Property Regimes have
been approved for 2 lots in the Kamuela Plantation, 14 lots in Kanehoa Subdivision and 14 lots
in Anekona Estates Subdivision.
The property is not situated within the Special Management Area, as it is located approximately
six miles from the nearest coastline.

The parcel to the west of the subject property has a SLU Rural designation. The parcels to the
east and across Keanuiomano Stream have the SLU Agricultural designation and are zoned
Agricultural (A-Sa). Other surrounding lands include the South Kohala View Estates which is
designated Urban by the State Land Use Commission, and zoned Single Family Residential (RS-
15). To the immediate west of Kamuela Plantation is the 28-parcel Kanehoa Subdivision and the
42-parcel Anekona Estates Subdivision.
The ALISH system designates the subject property and surrounding area as "Unclassified". The
Land Study Bureau's Detailed Land Classification is "D" or "Poor" for agricultural productivity.
The U S Soil Survey classifies the soils as Puu Pa, an extremely stony very fine sandy loam with
moderately rapid permeability, medium runoff and moderate erosion hazard which are used for
pasture.
The property is located within Zone X, an area determined to be outside the 500-year flood plain.
Because the site has been grazed by cattle, partially graded, undeveloped and overgrown with
natural vegetation, the applicant does not believe there are any rare or endangered flora or fauna
in the vicinity, nor are there any historical, cultural or archaeological features on the site.
Access is from Kawaihae Road, a 20 foot wide pavement within a 60-foot right of way.
There is an existing 6-inch water line along the Kawaihae Road fronting the subject property.
There is no municipal sewer system in the area, so the applicant will be required to dispose
wastewater into a septic tank system.
All other utilities and services are or will be available to the subject property.
Committee Member Curtis Tyler amended Bill No. 224 to include language to prohibit the
construction of condominium property regimes.
Committee Member Julie Jacobson stated she sees no public purpose in this amendment
therefore would be voting against this measure.
Your Committee concurs with the Planning Commission and the Planning Director for
recommending a favorable consideration for the change of zone request.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 224, as
amended to Bill No 224, Draft 2, and recommends it pass first reading.
