Your Committee on Planning, to which was referred Bill No. 81, by Council Member Bobby
Jean Leithead-Todd, per Communication No. 283, dated August 1, 2001, regarding the
amendment to Chapter 25, the zoning code, relating to height limits in North Kona, reports as
follows:
Bill No. 81, originally agendized on August 14, 2001, amends Chapter 25 (Zoning Code) of the
Hawaii County Code by amending Article 5, Section 25-5-113 to decrease the height limit in the
CG zoned properties in North Kona from ninety feet to forty-five feet.
Pursuant to the Zoning Code, Bill No. 81 was referred to the Planning Commission. At the
Commission's February 1, 2002 meeting, the measure received four aye votes and three no votes
for a favorable recommendation; however, because the 120 day time limit to provide comments
had lapsed, the Commission decided to forward an unfavorable recommendation to the Council.
Because this measure affects the height limits in the North Kona Commercial Zone, Your Chair
decided to hear this measure in Kona. At tonight's meeting, there was only one testimony from
the public regarding this measure, and it was neither for nor against the measure.
Your Committee did not entertain any discussion on this measure.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 81, and
recommends it pass first reading.
