HomeMy WebLinkAboutREP PC 092 07/02/2002 2000-2002 REPORT OF THE COMMITTEE ON PLANNING DATE: July 2, 2002 RE: C-675 /Bill No. 234 PLACE: Councilroom TIME: 11:10 a.m. Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No. 234, transmitted jointly with Bill No. 233 by Mayor Harry Kim, per Communication No. 675, dated June 6, 2002, regarding the change of zone request by U of N Bancorp, at Waiaha 1st, North Kona, Hawaii, TMK: 7-5-17: portion of 7, reports as follows: Bill No. 234 amends Section 25-8-3 (North Kona Zone Map), Article 8, Chapter 25 (Zoning Code), by changing the district classification for approximately 4.979 acres of land from an Agricultural (A-la) to a Multiple Family Residential (RM-4) zoned district. Because the title of Bill No. 234 inadvertently stated that the district classification was being changed from an Agriculture (A-la) to an Urban (RM-4) zoning district, Your Committee requested that the Planning Department submit a replacement bill. Replacement Bill No. 242 was not received in time for today's meeting, so it will be waived to Council at the same time Bill No. 234 is to be filed. These two bills, in addition to Bill No. 233 will all appear on the Council agenda at the same time. Bill No. 242, correctly amends Section 25-8-3 (North Kona Zone Map), Article 8, Chapter 25 by changing the district classification for approximately 4.989 acres of land from an Agricultural (A-1 a) to a Multiple Family Residential (RM-4) zoned district. The 4.979 acre subject parcel is part of a larger 9.663 acre parcel (Parcel 86), which is owned in fee by the applicant, and is located along the west side of Hualalai Road at its intersection with the Queen Kaahumanu Highway Extension, and adjacent to the proposed Hualalai Village-Phase 1 A development. On May 12, 1980, Ordinance No. 80-659 rezoned a portion of the affected property and adjoining lands from a Resort (V-1.25) to a Multiple Family Residential (RM-4) zoned district. On September 18, 2001, Final Subdivision Approval was issued and parcel 86 was created from a larger 58.488 acre parcel, which includes the current site of the University of the Nations complex. On November 29, 2001, the Planning Department issued Final Plan Approval for Hualalai Village-Phase 1 A to allow the construction of three condominium buildings containing a total of 51 condominium units. The applicant is seeking the State Land Use Boundary Amendment and the change of zone amendment to accommodate Phase 1 B of the proposed Hualalai Village condominium complex which is to consist of 52 condominium units within the five condominium complexes. PC-92 PC-92 - 2 - July 2, 2002 The General Plan LUPAG Map designation is Medium Density Urban, which allows for village and neighborhood commercial uses up to three stories and residential and related functions not to exceed a density of 35 units per acre. The Kona Regional Plan adopted by the Planning Commission in April 1984, designates the area as Residential-10 to 14 units/acre. The Master Plan for Kailua-Kona, adopted by Council Resolution in 1996, recommends the project site be developed for low density residential uses, such as single family, duplex and townhomes. The subject parcel is situated within the project area identified as the Kailua Village Special District. The subject property is not situated within the Special Management Area. Surrounding lands to the south and west are zoned A-la. Adjacent to the north is the remaining portion of the 9.663 acre property and the University of the Nations complex on lands zoned RM-4. Hualalai Road borders the project site to the east. Kona Hillcrest Subdivision is situated approximately 300 to 350 feet south of the project site on lands zoned RS-7.5. The subject parcel is located within Zone "X", an area outside the 500-year flood plain. The Master Plan for Kailua-Kona proposes a storm sewer project through the project site and recommends that the applicant address this proposed storm sewer project. The ALISI-1 Map does not classify the soils within the subject parcel. The USDA soil classification is Punaluu Extremely Rocky Peat, which consists of well-drained thin organic soils over pahoehoe with rapid permeability, slow runoff and slight erosion hazard, which is used for pasture. The Land Study 13ureau's overall master productivity for agricultural use of soils is Class "E" or Very Poor. No known endangered flora, fauna and archaeological sites are known to exist on the subject parcel. Primary access to the subject parcel is from Hualalai Road, a County roadway with a pavement width of 20 feet within an approximately 40-foot wide right-of--way. A Traffic Impact Analysis Report states that "the first phase of the proposed project is not expected to have an adverse traffic impact on the local Kona roadway network. Water will be available from the County's water system. All other utilities are or will be made available to support the proposed project. PC-92 PC-92 - 2 - July 2, 2002 The applicant proposes to tie into the County's Kealakehe Wastewater Treatment Facility through an existing sewer line through the University of the Nations complex which connects to the County sewerage system along Kuakini Highway. Written testimonies regarding this measure indicate the residents from the Hillcrest Subdivision do not want through traffic through the proposed connector road. They are willing to connect the road, but prefer to have it gated and used only in times of emergencies. Discussion on this matter will be heard when the measure is placed on the Council's agenda as Bill No. 242. Your Committee did not entertain further discussion on this measure. Your Committee on Planning is not in accord with the intent and purpose of Bill No. 234, and recommends it be filed.
