Your Committee on Planning, to which was referred Bill No. 235, transmitted by Mayor Harry
Kim, per Communication No. 676, dated June 6, 2002, regarding the change of zone request by
Yoshiko and Saran Balehtiary, at Kapalaalaea 2"d, North Kona, Hawaii, TMK: 7-7-7:46,
reports as follows:
Bill No. 235 amends Section 25-8-3 (North Kona Zone Map), Article 8, Chapter 25 (Zoning
Code), by changing the district classification for approximately 5.001 acres of land from an
Agricultural (A-Sa) to a Family Agricultural (FA-2a) zoned district.
The flag shaped lot, owned in fee by the applicants, is located at the end of Nohealani Street
mauka of Kauhou Uka Subdivision and approximately 600 feet east of Walua Road-Nohealani
Street intersection. It is currently vacant and overgrown with vegetation.
The applicants plan to subdivide the subject parcel into two lots consisting of 2.913 acres and
2.088 acres respectively. One lot will be used to construct their home, and the other will be used
to construct their parents' home. The remaining space will be used for asmall-scale farm.
The subject parcel was originally part of a 17.899 acre parcel which was subdivided into three
five-acre parcels by A & E Enterprises, Ltd., the previous owner.
The State Land Use designation is Agricultural. The General Plan LUPAG Map designation is
Extensive Agriculture, which is used for pasturage and range lands. The Kona Regional Plan,
adopted by the Planning Commission on April 10,1984, designates the area for Agriculture.
The property is not situated within the Special Management Area, as it is located about two miles
from the nearest shoreline.
The USDA Soil Survey classification is Punaluu extremely rocky peat, consisting ofwell-drained
thin organic soils over pahoehoe lava bedrock with rapid permeability, slow runoff and slight
erosion hazard, which is used for pasture. The Land Study Bureau's Classification is "E" or
Very Poor for agricultural productivity. The State ALISH System does not classify the soils.
Because the property was previously cleared and used for cattle grazing for over 50 years, there
are no known or recorded rare or endangered animal or plant life in the area; and there are no
known archaeological, cultural or historic sites located on the property.

Surrounding properties include a parcel immediately to the west which was rezoned from A-Sato
FA-2a in August 1999. To the north and south are lands zoned A-Sa with mixed residential,
coffee cultivation and pastoral uses. To the east are lands zoned A-1 a with mixed residential-
agricultural uses.
The primary access to the subject property is via Nohealani Street, a County road having a 60-
foot right-of--way with paved shoulders and swales.
The property is located within Zone X, an area outside the 500-year flood plain.
Water is available through the existing 12-inch waterline along Mamalahoa Highway. There is
no municipal sewer system in the area, so wastewater will be disposed of in accordance with the
requirements of the Department of Health.
All other essential utilities and services are available to the subject property.
Your Committee did not entertain any discussion on this measure.
Your Committee concurs with the Planning Commission and the Planning Director for
recommending a favorable consideration for the change of zone request.
Your Committee finds that the conditions included in the Bill No. 235, "are (1) necessary to
prevent circumstances which may be adverse to the public health, safety and welfare; and (2)
reasonably conceived to fulfill needs directly emanating from the land use proposed with respect
to (A) protection of the public from the potentially deleterious effects of the proposed use, or (B)
fulfillment of the need for public service demands created by the proposed use. In this case,
these conditions are imposed because of concerns over highway access and to control the overall
density in the subdivision."
Your Committee on Planning is in accord with the intent and purpose of Bill No. 235, and
recommends it pass first reading.
