Your Committee on Planning, to which was referred Bill No. 23b, transmitted by Mayor Harry
Kim, per Communication No. 677, dated June 6, 2002, regarding the change of zone request by
T®isan Ass®ciates, a)EIawaii Limited Partnership, at Puukapu, Waimea, South Kohala,
Hawaii, TMK: 6-4-24:22, reports as follows:
Bill No. 236 amends Ordinance No. 94-56, which reclassified lands from Agricultural (A-Sa) to
Neighborhood Commercial (CN-10), by changing the district classification for approximately
26,585 square feet of land. Bill No. 236 amends the metes and bounds description of Parcel 22,
because Parcel 22 was originally disclosed as being 26,732 square feet in size based on a survey
by Richard H. Cassera on March 22, 1993. However, when Parcel 23 was surveyed by Wes
Thomas Associates on January 30, 2002, as part of a concurrent rezoning request by the
applicant, it was determined that Parce122 was actually 26,585 square feet in size.
Bill No. 236 also seeks to amend Conditions C and D by extending the deadline for the required
construction of the new proposed development and by revising or deleting the street lighting,
curb, gutter and sidewalk improvement requirements along Mamalahoa Highway fronting the
subject parcel.
With the passage of Ordinance No. 94-56, the applicant proposed to rebuild instead of
remodeling the Fukushima Store, which is located on the rectangular shaped subject property on
the south side of Mamalahoa Highway. No plans were submitted at that time, and Condition C
specified that construction of the new proposed development be completed within five years
from the Ordinance's effective date. No administrative extensions of time were granted.
Since the initial rezoning, the conditions and development objectives have changed. Instead of
demolishing the Fukushima Store and constructing a new commercial building, the applicant is
retaining the existing building without alterations to preserve the historic facade, while
consolidating the subject parcel with parce123. A concurrent request to rezone parce123 to CN-
10 is also being considered. Any new improvements for the consolidated parcel would comply
with County requirements and new structures would have a "Waimea historic character design"
similar to that of the Fukushima Store, which was constructed in the 1940's - 1950's as a store
and residence. However, because no new commercial buildings will be constructed on parcel
22, the applicant is requesting that the curb, gutter and sidewalk requirements be deleted from
Condition D and that the requirements be revised to be more in keeping with the village character
of the community's surroundings.

A small apartment for amaintenance/security person will be included in the Fukushima Store
building as part of the overall plan of developing a consolidated parcel. Proposed new buildings
will be located entirely on the adjacent Parce123, after it is rezoned and consolidated with the
subject property. Existing parking fronting the main highway will be eliminated when the
consolidated property is developed. All parking will be in the rear of the consolidated parcel, and
will be ADA accessible.
The subject property is located within the State Urban District, which ends approximately 300
feet east of the subject parcel. The General Plan LUPAG Map places the property in the
transition area between Medium Density Urban and Low Density Urban designations, but both
designations allow for Neighborhood Commercial (CN) zoning and its permitted uses.
The Waimea Design Plan, adopted by the County Council on October 1, 1986, states "the
construction of roads to rural standards -without curbs, gutters and sidewalks, is a major aspect
of the ranch character of Waimea." The Plan also recognizes the need "to consolidate
commercial growth around the emerging town center" and "to preserve and enhance the form and
function of Waimea's commercial areas."
The subject property is not situated within the Special Management Area.
Access to the property is directly off Mamalahoa Highway, a County road right-of--way with an
approximately 20-foot wide pavement.
Surrounding properties to the east and both sides of the main highway are zoned A-Sa and 1ZS-
15.
The ALISH System designation for the property and surrounding area is "Unclassified".
There are no known or recorded rare or endangered animal or plant life in the area; and there are
no known archaeological, cultural or historic sites located on the property.
The property is located within Zone "AE", an area where base flood elevations have been
determined.
Water is available through a 5/8 inch water meter. All other essential utilities and services are
available to the subject property.
Since there is no municipal sewer system, wastewater will be disposed of in a septic tank system
in accordance with Department of Health regulations.
Your Committee did not entertain any discussion on this measure.

The Planning Commission concurred with the Planning Director to delete Condition C in its
entirety instead of amending it, due to the applicant's change of plans to not further develop the
subject property with additional commercial structures. The Planning Commission also concurs
with the Planning Director to retain Condition D, as written, because it allows the applicant to
preserve Fukushima Store in its present location while ensuring that road improvements will be
done if and when any new development occurs, although the applicant requested to either revise
or delete Condition D of Ordinance No. 94-56.
Your Committee concurs with the Planning Commission and the Planning Director for
recommending a favorable consideration for the change of zone request.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 236, and
recommends it pass first reading.
