Your Committee on Public Works and Intergovernmental Relations, to which was referred Communication
No. 639, and attached Resolution No. 215-02, reports as follows:
Communication No. 639, dated May 16, 2002, is from Assistant Corporation Counsel Gerald Takase,
transmitting for the Council's review and consideration, Resolution No. 215-02, which authorizes the
acquisition of private properties and easements in the District of North Kona, for the Kahului-Keauhou
Parkway project.
Resolution 215-02 explains that in order to complete the Kahului-Keauhou Parkway project, which is aimed at
easing traffic congestion in North Kona, the County must acquire property using eminent domain powers.
This resolution authorizes the Office of the Corporation Counsel to initiate condemnation proceeding for the
purpose of constructing this parkway. Also attached to the resolution, "Exhibits 1 through 23" further
delineate parcels to be included within this action.
At this meeting, the Office of the Corporation Counsel clarified condemnation procedures and fielded
questions from Committee Members about State Statutes and the County Charter in relation to such
proceedings. In addition, during discussion a friendly amendment was recognized requesting that the
appropriate diacriticals be included within this resolution. Councilmember Tyler also suggested that the
Department of Public Works look into amending the resolution so that the project name, Kahului-Keauhou
Parkway, can be enclosed in quotations.
Councilmember Tyler, concerned with the Office of the Corporation Counsel's legal authority to initiate
condemnation proceedings, voted kanalua "no" on this matter.
Your Committee on Public Works and Intergovernmental Relations is in accordance with the purpose and
intent of Resolution No. 215-02, as amended to Draft 2, and recommends that it pass first reading.
