Re: Operating Budget
Under a Settlement Agreement between KELLY Plaintiffs, State Department of Health (DOH), and
the County of Hawaii, the State is required to provide $60,000 of EPA grant funds to the County
for its project to update the Grading Ordinance. This project includes the updating of Chapter 10,
Erosion and Sedimentation Control, of the Hawaii County Code and also identifying, educating,
and training in implementing best management practices to protect coastal waters, watersheds,
and wetlands from soil erosion and sediment loss. Due to higher anticipated project costs, DOH
has now agreed to provide $70,000. The Settlement Agreement also requires the transfer of
$12,500 to the County from 1250 Oceanside Partners.
Enclosed is a resolution to authorize the Mayor to enter into a contract for goods and services with
the State of Hawaii Department of Health.
Also enclosed is a bill for an ordinance amending the Operating Budget by appropriating the grant
funds of $70,000 and by increasing the private contributions account by $12,500.

A. REQUEST:
Amendment to Ordinance Bill 02-76 to add the Grading Ordinance Amendment
project. Work to include updating Chapter 10, Erosion and Sedimentation
Control, of the Hawaii County Code and also to identify, educate and
train appropriate staff, contractors, and other interested persons in
implementing best management practices to protect coastal waters,
watersheds, and wetlands from soil erosion and sediment loss. This
appropriation is for $70,000 of Federal funds and for $12,500 of private
funds.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
This project is required by a Settlement Agreement between KELLY
Plaintiffs, State Department of Health and the County of Hawaii. KELLY
Plaintiffs will arrange for the transfer of $12,500 from 1250 Oceanside
Partners to the County of Hawaii and the State Department of Health will
provide for $70,000 of EPA grant funds to the County of Hawaii for this
project. Any other matching funds will be provided by County or
volunteer labor charges.

NOW, THEREFORE, in consideration of the promises contained in this Contract,
the STATE and the CONTRACTOR agree as follows:
1. Scope of Services. The CONTRACTOR shall, in a proper and satisfactory
manner as determined by the STATE, provide all the goods or services set forth in Attachment 1,
which is hereby made a part of this Contract.
2. Compensation. The CONTRACTOR shall be compensated M -a total amount

7. Notices. Any written notice required to be given by any patty to this Contract

SCOPE OF SERVICES
The CONTRACTOR shall assist the STATE to improve the water quality for the County
of Hawaii (County) by reducing sediment runoff into their receiving waters. The
CONTRACTOR will propose that the County Council update the County's current
Erosion and Sediment Control Ordinance adopted in 1975, and identify, educate and
train appropriate staff, contractors, permittees and other interested persons in
implementing new techniques such as best management practices to protect the
County's coastal waters, watersheds, and wetlands from further soil erosion and
sediment loss. The CONTRACTOR shall produce a Best Management Practices (BMP)
Manual for construction sites in the County.
The CONTRACTOR's project proposal "County of Hawaii, Erosion and Sediment
Control Ordinance Update" is attached hereto as Exhibit "A," and made part of this
Contract. In the event of a conflict, Attachment 1 shall prevail.
The CONTRACTOR shall submit to the STATE items printed in italics no later than the
dates indicated in paragraph I. Project Timeline.
The CONTRACTOR's responsibilities include, but are not limited to, providing all
necessary labor, materials, equipment, supplies and supervision to accomplish the
activities described hereinafter:
A. Professional Services
The CONTRACTOR shall select and hire a qualified individual or firm as a
subcontractor to assist them in revising the County's Erosion and Sediment
Control Ordinance adopted in 1975, and produce a BMP Manual for construction
sites in the County, to develop audio and/or visual aids illustrating best
management practices, and to facilitate workshops and training sessions. The
CONTRACTOR shall be required to enter into a contract with the subcontractor
to provide these services. The CONTRACTOR shall be required to submit to the
STATE the name of the subcontractor, their qualifications (i.e., work experience,
areas of expertise, etc.) and a copy of the executed contract.
1. Submit to the STATE, within one (1) month from the date on the STATE's
Notice to Proceed (NTP), the minimum qualifications of the subcontractor to
be hired and a draft of the contract to be executed. The draft contract to be
submitted shall include items such as term of contract, work plan, timetable,
estimated compensation amount, scope of work, etc. The work plan shall be
an outline of all activities to be performed in accordance with the update and
include, but not limited to, list of participants and organizations to be involved,
number of planned public meetings, review and approval process, etc. The

timetable shall list the activity in order and the estimated number of days to
complete the activity.
2. The STATE shall have one (1) month to provide comments to the
CONTRACTOR. The CONTRACTOR shall incorporate the STATE's
comments into the final contract.
3. Submit to the STATE, within three (3) months from the date on the NTP, a
copy of the final executed contract between the CONTRACTOR and the
subcontractor.
B. The CONTRACTOR shall provide work products produced as a result of the
subcontract to accomplish the update of the County's Erosion and Sediment
Control Ordinance adopted in 1975, including the revised ordinance, the BMP
Manual, audio and/or visual aids illustrating best management practices, and
information on workshops and training sessions.
1. The CONTRACTOR shall submit to the STATE within twelve (12) months
from the date on the NTP, the draft ordinance produced by their subcontractor
to update the Erosion and Sediment Control Ordinance adopted in 1975.
2. The CONTRACTOR shall submit to the STATE within twelve (12) months
from the date on the NTP, one (1) original and five (5) copies of the final BMP
Manual for construction sites. The CONTRACTOR shall prepare the draft
BMP Manual to include common types of construction best management
practices used for erosion controls, sediment controls, and construction waste
management. Each individual BMP listed shall have respective details and
specifications to include, but not limited to, definition, purpose, applicability,
planning consideration, construction specifications, and maintenance
requirements. The draft BMP Manual shall be submitted to the STATE within
ten (10) months from the date on the NTP. The STATE shall have one (1)
month to review and provide comments on the draft manual to the
CONTRACTOR. The CONTRACTOR shall incorporate the STATE's
comments into the final BMP Manual to be submitted within twelve (12)
months from the date on the NTP. The CONTRACTOR shall attach a copy of
the BMP Manual to the Final Report.
3. The CONTRACTOR shall submit to the STATE within five (5) months from
the date on the NTP for review and comment an outline and/or description of
the proposed audio and visual aids to be developed illustrating BMPs. At a
minimum, the audio and visual aids shall (a) discuss that a best management
practice is a practice or combination of practices that are effective and
practicable for controlling nonpoint source pollutants at levels compatible with
environmental goals; (b) include examples of different types of BMPs; (c)
discuss ways to maximize the nonpoint source pollution reduction benefits of
specific BMPs; and (d) discuss Operation and Maintenance requirements of

BMPs. The STATE shall have one (1) month to comment on the proposed
aids and those comments by the STATE shall be incorporated into the final
audio and/or visual aids. The final audio and/or visual aids shall be
completed within twelve (12) months from the date on the NTP and a copy
shall be submitted to the STATE.
4. The CONTRACTOR shall submit to the STATE within twelve (12) months
from the date on the NTP for review and comment a proposal and draft
agenda for the proposed workshops and training sessions and a schedule for
providing the workshops and training sessions. A minimum of four (4)
workshops and four (4) training sessions shall be conducted. The proposal
shall include, at a minimum, the following items: (a) purpose of workshops
and training sessions; (b) target audience; (c) possible locations and dates;
(d) number of meetings (if more than 4 meetings are to be held); and (e)
method to be used to advertise the workshops and training sessions. The
agenda shall include, at a minimum, the following items: (a) the importance
of erosion and sediment control; (b) the proposed or new revised Erosion and
Sediment Control Ordinance; (c) principles of erosion and sediment control;
(d) BMP Manual; and (e) BMP operation and maintenance requirements.
The STATE shall have one (1) month to review and provide comments on the
proposal and agenda to the CONTRACTOR. The CONTRACTOR shall
incorporate the STATE's comments into the final agenda. The number of
attendees for the workshops and training sessions shall be provided in the
corresponding quarterly status reports.
The CONTRACTOR shall complete the workshops and training sessions in
accordance with the STATE's prior approved proposal and agenda for the
workshops and training sessions within twenty-two (22) months from the date
on the NTP. The CONTRACTOR shall follow the County of Hawaii process
necessary to propose to the Hawaii County Council a draft ordinance to
update or replace the Erosion and Sediment Control Ordinance adopted in
1975 by the County of Hawaii. Upon completion of the workshops and
training sessions, the CONTRACTOR shall submit to the STATE a list of
workshop and training participants. The STATE shall have the sole option of
attending any of the workshops and/or training sessions.
C. Within thirty (30) months from the date on the NTP, the CONTRACTOR shall in
good faith propose to the Hawaii County Council a draft ordinance to update or
replace the Erosion and Sediment Control Ordinance adopted in 1975 by the
County of Hawaii. The CONTRACTOR shall attach to the Final Report submittal
six (6) copies each of the adopted updated County of Hawaii Erosion and
Sediment Control Ordinance.

F. Reports
1. Prepare and submit to the STATE one (1) copy each, unless otherwise
specified, of the following written reports:
a. Quarterly status reports to the STATE on or before January 15th, April 15tH
July 15th, and October 15th of each respective calendar year following the
STATE's NTP until the final report is submitted. The reports shall be
submitted in the format provided by the STATE, attached hereto as Exhibit
"B," and made a part of this Contract. The reports shall include the status
of all project activities required under this Contract including meeting
minutes and summaries, analyses, monitoring activities and results,
construction and maintenance activity performed, and outreach activities
that occurred in the respective quarter.
b. A Final Report describing the services performed and the benefits and
outcomes of the services performed under this Contract. Three (3) copies
of the Draft Final Report shall be submitted to the STATE on or before
twenty-two (22) months from the date on the STATE's NTP. The report
shall be submitted in the format provided by the STATE, attached hereto
as Exhibit "C," and made a part of this Contract. The STATE shall have
one (1) month to review and comment on the draft final report. Comments
made by the STATE shall be incorporated into the report before finalizing
the document. The CONTRACTOR shall submit one (1) unbound original
and five (5) bound copies of the completed Final Report to the STATE on

or before thirty (30) months from the date on the STATE's NTP. The
CONTRACTOR shall attach to the Final Report submittal six (6) copies
each of the updated County Erosion and Sediment Control Ordinance and
one copy of the BMP Manual.
c. Monthly grant expense reports shall be submitted to the STATE in the
format provided by the STATE, attached hereto as Exhibit "D," and made
a part of this Contract. Failure by the CONTRACTOR to submit reports to
the STATE in the approved format shall delay payments to the
CONTRACTOR by the STATE.
d. A final expenditure report and in-kind contributions report shall be included
with the Final Report, to the STATE.
2. The CONTRACTOR shall provide reports in typed or printed forms and in an
electronic format specified and approved by the STATE for posting on an
Internet site approved by the STATE.
G. The CONTRACTOR shall obtain at least SIXTY-ONE THOUSAND, EIGHT
HUNDRED NINETY AND NO/100 DOLLARS ($61,890.00) of non-federal private
and public in-kind contributions and donations as sub-recipient matching funds to
support the project activities under this Contract. The matching funds shall meet
the substantive and documentation requirements of 40 Code of Federal
Regulation (C.F.R.) Section 31.24.

adopted in 1975, since then, there were only a few minor revisions to this ordinance. As such,
it is much outdated. The County of Hawaii has been experiencing problems with imposing new
requirements such as a Best Management Plan submittal for each permit and has also been
unable to effectively enforce compliance. The end result has been grading work being
improperly performed. The resulting sediment runoff has been detrimental to our receiving
waters. Polluted runoff is a major cause of water quality degradation in Hawaii.

7. PROJECT PURPOSE: (Describe what is to be demonstrated or implemented, be specific.)
We propose to update our grading ordinance and identify, educate and train appropriate staff,
contractors, permittees (or the general public) and other interested persons in implementing
best management practices to protect our coastal waters, watersheds, and wetlands from soil
erosion and sediment loss.
8. PROJECT GOALS: (Describe the NPS pollutants to be prevented, controlled, and/or reduced
and to what extent.)
We anticipate to meet the following goals and/or objectives:
a. To the maximum extent possible, reduce or eliminate sediment and other pollutants
resulting from soil erosion from reaching a waterbody by updating the county's grading
ordinance and implementing the requirement of best management practices.
b. Improve water quality for animal and aquatic habitat.
C. Implement and maintain water quality standards affecting grading operations.
d. Adopt a set of priorities to apply the best available technology to control soil erosion
and sediment loss.
e. Establish a monitoring program to detect, remove, and/or reduce pollutants in
residential and commercial grading operations.
f. Provide better enforcement of the grading ordinance and best management practices.
g. Provide continuing education and training programs for inspectors, contractors,
engineers, and the general public.
9. PROJECT BENEFITS: (Describe the expected results, impacts, and/or benefits of the project.)
Non-point source pollution will be reduced, thereby improving water quality for the stream and
marine environment.

Although this project is a "stand alone" project for the County of Hawaii, it will complement
other programs/projects relating to erosion control by other agencies such as the State
Department of Health, the USDA Soil Conservation Service and the U.S. Army Corps of
Engineers.

Emphasis will be place on education and enforcement to insure public awareness and
compliance with applicable regulations. It is hoped that parameters such as, a reduction
in the number of violations issued and complaints received from the public and the
improved quality of adjacent and downstream water bodies will indicate the success of
this program.

We will be conducting informational workshops and training sessions. These sessions
will acquaint the public and governmental agencies with the principals of soil erosion
and sediment control laws relating to non point source pollution. The County's revised

practices to prevent and reduce pollutants reaching water bodies. The participants will
also be advised of available literature, audio and videotapes, and other resource
materials.
