Your Committee on Finance, to which was relcrred Resolution No. ?,7-02, reports as follows:
Resolution No. 237-02, transmitted by Council Memher.l. Curti, Tyler. III, via Communication No. 729,
dated August 2 2002, is a determination by the Council to proceed to create and define a water s~-stem
itnprovemcnt district for the Kona Coastvic~~~ and Kona Wondervicw Suhdivisions.
On June 19, 2002, the Hawaii County Council adopted Resolution No. ?20-02, Ura1~t which proposed the
establishment of a water improvement district for the Kona Coastview and Kona Wonderview Suhdivisions,
and required the Clerk to set a date for a public hearin~~ on the matter pursuant to Chapter 1?-10, Ha~~ai`i
County Code.
On August 2, 2002, the Council held the public hearing at 6:00 p.m. at Kcalakche lntermediatc School. The
Council received a total of tour letters in support and fourteen lcuers in opposition to the proposed V~~ater
System Improvement District ("I?~hibit C"). Since the total number ofpropcrty o~~~ners who tiled ~~~rittcn
objections before or at the date and time of~the public hearing constituted less then ti 1 01~ the total number
of owners of assessment units (4 ~5) affected by the proposed Improvement District, the Council has decided
to proceed with the proposed improvement. For reference, please see the full transcript of the August 2nd
Public Hearing, attached as "Exhibit B" and other related exhibits.
Some members of Your Committee questioned the concerns of residents who are on County Water. Rorv
Flynn of the Legislative Auditor's Office noted that ~~~hile over 100 property owners within Kona Coastview
and Kona Wonderview have "county water" insofar as private consumer lines are hooked up to Department
of Water Supply (DWS) meters, those residents are not on a "county-standard water distribution system,..
which the improvement disU-ict shall install. Moreover, a provision in the resolution to establish the
improvement district allows for ~yaiver of payment of facilities charges (~yatcr meters) for those o~~ners who
can demonstrate proof of prior payment to DWS.
Your Committee on Finance is in accord ~~ith the purpose and intent ol~ Resolution No. ,7-O'_ and
recommends its adoption.
