SUBJECT: Transmittal of Resolution No. 236-02, Draft 3
Attached, for your information, I am transmitting the final text of Resolution No. 236-02, Draft 3, reflecting
floor amendments adopted by the Council during its meeting on September 25, 2002. For your reference,
the amendments to Resolution 236-02, shown in ramseyer format, are as follows (material deleted is
bracketed; new material is underscored):
1. Title. The title of the resolution was amended as follows: "A Resolution Supporting [a
Moratorium on the] the Development of a Regional Review Protocol Prior to And Release
[and] or Planting of Genetically Modified (GM) Coffee in the Districts of North and South
Kona in Order to Assure and Protect the Biotic Integrity and Market Value of Pure Kona
Coffee."
2. Additional "Whereas" Provision. Anew "Whereas" clause was added as follows:
"W)FIEI~EAS, the Kona coffee industry and the University of Hawaii Colle,~e of Tropical
Agriculture and Human Resources have expressed an intention to work together on an ongoing
basis to continually reevaluate the potential consequences to the release of GM coffee stock."
3. Amendgnent to ls~ "Re It Resolved" Clause. The first "Now, Therefore, Be It Resolved"
paragraph was amended as follows: "NOW, TIIEItEFOI2E, SE IT IIESOLVED I3Y TIIE
COUNCIL OF TIIE COUNTY OF I-IAWAI`I that the Council, in response to concerns
expressed [supports the request] by the Kona Coffee Council, the Kona Farmers Alliance, the
Kona County Farm Bureau, the Kona Pacific Farmers Cooperative, the Hawaii Coffee
Association, [and] the Hawaii Organic Farmers Association, as well as individual Kona coffee
farmers supports the development of a regional review protocol prior to any [for the
imposition of a moratorium on the] release [and] or planting of genetically modified coffee
plants in the Districts of North and South Kona_ [until a regulatory regime has been developed
by the appropriate government agency or agencies in collaboration with the Kona farmers'
organizations that includes extensive evaluation of genetic contamination from pollen drift and
other environmental consequences and secondary ecological effects in order to assure that the
biological integrity of Kona heritage coffee is preserved and the market value of Kona coffee is
protected from any adverse consequences and secondary effects associated with the
development of GMO coffee stock and its release.]" ~

4. Additional "Re It Further Resolved" Clause. Finally, one additional `Be It Further
Resolved clause was adopted as follows: "13E IT FUItTIIER IZES4LVED that the Hawaii
County Council recognizes the success of genetical modified science specifical~ in the
Hawai`ipapaya industry and is not opposed to the development and research of genetically
modified coffee."
