(Draft 2) RESOLUTION ACCEPTING THE DEDICATION OE PARCEL 15 FROM THE ISLAND OF HAWAII YMCA, SITUATE AT PAHOEHOE 3RD, PAHOEHOE 4TH, AND LA`ALOA 1ST, NORTH KONA, COUNTY AND STATE OF HAWAII, TAX MAP KEY:(3)7-7-008-030 (PORTION), TO THE COUNTY OF HAWAII FOR THE KAHULUI-KEAUHOU PARKWAY. WHEREAS, THE ISLAND OF HAWAII YMCA ("YMCA"), is the owner of Parcel 15 located at Pahoehoe 3rd, Pahoehoe 4th, and La`aloa 1st, North Kona, Hawaii, specifically identified as Tax Map Key:(3)7-7-008-030 (portion), being more particularly described and delineated in the attached dedication deed (Exhibit "1 and WHEREAS, YMCA acquired the subject property from Towne Keauhou LLC; and WHEREAS, Towne Keauhou LLC was required to provide and dedicate said right-of-way to the County of Hawaii at no cost to the County for use in the Kahului-Keauhou Parkway project, pursuant to condition F of Ordinance No. 97-42; and WHEREAS, the County has requested dedication of the right-of-way for use in the Kahului-Keauhou Parkway project; and WHEREAS, YMCA is desirous of dedicating the subject right-of-way to the County of Hawaii; and WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the Council may accept gifts which include the dedication of land on behalf of the County of Hawaii; NOW, THEREFORE, SE IT RESOLVED SY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, that the County of Hawaii accepts the real property in the attached dedication deed (Exhibit "1 and more specifical y identified as Tax Map Key:(3)7-7-008-030 (portion), for the Kahului-Keauhou Parkway project.
