AN ORDINANCE AMENDING CHAPTER 2 OF THE HAWAII COUNTY CODE 1983 (1995
EDITION), RELATING TO THE DIRECTOR OF PUBLIC WORKS (POWER TO ADOPT
RULES AND REGULATIONS; PENALTY).
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 2, article 9, Division 1, of the Hawai` i County Code ] 983 (1995
Edition), is amended by adding the following section to read as follows:
"Section 2-42, lsawer to adopt rules and regulations; penalty.
(a) The director of public works is authorized to adopt reasonable rules and regulations
necessary for the conduct of the de a~rtment's business as authorized and prescribed
including rules and regulations for fees and char eg s, special licenses, emits
concessions,;operations and use of county buildings, structures, and rg ounds, and for
the conduct of all persons while on or using count grounds. All rules and
regulations affecting private rights and procedures available to the public shall be
promul ag
tied in accordance with the Administrative Procedures Act, chapter 91
Hawaii Revised Statutes and section 13-7 of the Charter and shall have the force
and effect of law.
(b) Andperson who violates any rule or regulation promulgated under authority of this
section shall, upon conviction, be fined not more than the sum of $250, in addition to
any uenalties provided for by rule or regulation. Prosecution in such case shall be as
provided by law for the prosecution of misdemeanors."
SECTION 2. Material to be repealed is bracketed. New material is underscored. In
printing this ordinance, the brackets, bracketed material and underscoring need not be included.
SECTION 3. If any provision of this ordinance, or the application thereof to any person
or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid provision or application, and to this
end, the provisions of this ordinance are declared to be severable.
SECTION 4. This ordinance shall take effect upon its approval.
