AN ORDINANCE AMENDING CHAPTER 24 OF THE HAWAII COUNTY CODE 1983
(1995 EDITION), RELATING TO VEHICLES AND TRAFFIC, TO CLARIFY THE
DIRECTOR OF PUBLIC WORKS' AUTHORITY TO REGULATE PARKING AT COUNTY
FACILITIES.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 24, article 8, Division 5, of the Hawaii County Code 1983 (1995
Edition), is amended to read as follows:
"Division 5. Parking at County [Building] Facilities.
Section 24-228. [Director of public works to regulate parking at County building]
Authority to regulate parking at County facilities.
U The director of public works shall [assign and re -assign parking stalls and] be
responsible for regulating parking at the Hawaii County Building and Aupuni
Center complexes in Hilo, and at AU -County [building] buildings, structures, and
grounds, control of which is not otherwise delegated by charter or ordinance to any
other department of the Coup . Such parking includes public off-streetap rking,
employe parking, and special parking.
(b) Employee parking regulations shall be established by the director, provided that the
notice shall be made in writing not less than thirty days prior to the date the parking
controls would take effect.
(c) For special events, when compatible with County Operations, the director is
authorized to issue special permits for the use of Counly parking facilities after
regular working hours of the County, upon application made in writing in such form
as the director may establish for such purposes. Such special permits shall include
any reasonable conditions which the director may impose for the public health safety
or convenience. The terms and conditions and a schedule of fees for such special
permits shall be established by rule of the director pursuant to Administrative
Procedures chapter 91, Hawaii Revised Statutes.
Section 24-229. [Area of County lands regulated; hours.
(a) The area of County land on which parking is regulated will initially be confined to
the Hawaii County building complex in Hilo. Other areas may be subjected to
parking controls and this division shall also be applicable to those areas on a date to
be designated by written notice, which date shall be not less than thirty days after
the giving of such notice.
(b) The provisions of this division shall have application only during the regular
working hours of the County.] Reserved.
Section 24-230. Director of finance to set rates; theater parking; rental
computation.
(a) Rental in reserved parking shall be established by the director of finance. The
director of finance may change the rates effective as of a date to be designated in a
written notice thereof, which date shall be not less than thirty days after the giving
of such notice.
(b) The rental for reserved parking shall be on a month-to-month term, the applicable
rent to be in advance without notice or demand. County employees shall utilize
payroll deduction for the payment of the parking stalls.
(c) Rentals shall be computed on a semi-monthly and monthly basis applicable to
permanent and temporary parking privileges.
(d) County employees' and officials' rental for parking stalls and any public off-street
parking rental fees collected shall be deposited in the general fund."
SECTION 2. Material to be repealed is bracketed. New material is underscored. In
printing this ordinance, the brackets, bracketed material and underscoring need not be included.
SECTION 3. If any provision of this ordinance, or the application thereof to any person
or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid provision or application, and to this
end, the provisions of this ordinance are declared to be severable.
SECTION 4. This ordinance shall take effect upon its approval.
