Re: BILL No. 264, Draft 2 4.
Please replace Sill No. 264 with the enclosed Draft 2 of this same bill. The Department of
Public Works has requested that Sill No. 264 be amended to increase the settlement
appropriation from $12,500 to $22,500, change the revenue account from "Contribution from
Private Sources" to "Sundry Revenues - Current Year", and rename the expenditure account
title from "Erosion & Sediment Control - Private" to "Kelly Lawsuit Settlement Compliance".
The increase in appropriation is based on the Corporation Counsel's Office recommendation
to allow receipt of the entire $22,500 obtained from 1250 Oceanside Partners and to provide
an appropriate accounting mechanism that would allow there to transfer $10,000 to the State
Department of Health who will develop revised County rainfall maps. The change in revenue
account is being made to better suit the acceptance of the settlement and the renaming of the
expenditure account title is to make it more meaningful.

A. REQUEST:
1. To amend Bill 264 (requesting an ordinance to amend Ord. 02-76), by changing the Contribution from
Private Source to Sundry Revenues - Current Year (3611.04) and to increase the source amount from
$12,500 to $22,500.
2. Amend appropriation to reflect that the $22,500 is to be used to comply with settlement conditions of the
Kelly Lawsuit. Specifically, $12,500 is to be used to update Chapter 10 as originally described and $10,000
to be transferred to the State Department of Health as the County of Hawaii's contribution for the
development of revised County rainfall maps. Suggest changing function of account no. 010- 183-5183.20 to
Kelly Lawsuit Settlement Compliance.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED
Corporation Counsel's Office is recommending revision of Bill 264 to allow receipt of the entire $22,500 obtained
from 1250 Oceanside Partners and to provide an appropriate accounting mechanism that would allow them to
transfer $10,000 to the State Department of Health who will develop revised County rainfall maps. Note that the
State will make statewide revisions. However, if they are unable to secure funds for statewide revision, by the
terms of the Kelly Lawsuit settlement, DOH will make revisions to County of Hawaii rainfall maps.
