This is to acknowledge receipt of the Non-significant Zoning Change Application filed
on behalf of your client, Dorothy Washington, on October 14, 2002. The application has
been reviewed in accordance with Section 25-2-45 of Chapter 25, Hawaii County Code,
and Planning Department Rule No. 8, and is determined to be complete.
Your request is to adjust the boundaries of portions of two properties without increasing
the zoning densities of the area. Specifically, the following are the Tax Map Key
numbers, the current zoning districts, the proposed zoning districts, and the land areas
involved:

but the amount of land area for each zoning district remains the same. The transfer of the
affected zoning districts from one area to another will not result in any increase in zoning
densities.
Upon review of the request, we have determined that it complies with the criteria set forth
in Section 25-2-45(a)(1) of Chapter 25, Hawaii County Code, for determining non-
significant zoning changes. The transfer of zoning districts from one area to another will
not result in an increase in the land area to the current zoning districts. We, therefore,
administratively grant the requested non-significant zoning changes.

Dear Mr. Yuen:
The applicant is seeking a nonsignificant zoning change for portions of the two contiguous
parcels, which she owns, identified above per the provisions of Section 25-2-45 of the Zoning
Code.
Please find enclosed the original and five copies of the Nonsignificant Zoning Change Application;
site plan with location map; this letter which contains a written statement as to the purpose of the
request and why it qualifies as a nonsignificant zoning change; and a legal description of the
property affected by this request prepared by a surveyor. I have also enclosed a real property tax
clearance form for the property and a list of property owners within 300 feet of the subject
parcels. Once you acknowledge the completeness of this application I will mail a notice to these
neighbors and provide a certificate of mailing to your office confirming this notification.
Parcel 7-5-01:30 is a 9.685 acre parcel, zoned Agricultural 1-acre (A-1a). The adjacent parcel,
7-5-01:08, is a 25.162 acre parcel, zoned Agricultural 5-acre. The applicant is proposing to
subdivide these parcels based on their existing zoning. Unfortunately the configuration of these
two adjoining parcels with different zoning designations is such that the resulting lots are very
awkward if they follow the existing zoning lines. Please see the site plan enclosed.
The applicant proposes a nonsignificant zoning change that will create more geometrically shaped
lots of similar zoning, that would allow the creation of more usable lots in the subsequent
subdivision. The proposed action will result in no net change in the area of each type of zoning.
The applicant is proposing to change the zoning of a 0.625 acre portion of Lot 1 from A-1 a to A-
sa and to change the zoning of a 0.625 acre portion of lot 2 from A-5a to A-Ia. Please see the

site plan in the exhibits. We believe this proposed nonsignificant zoning change is consistent with
the Zoning Code which states:
Section 25-2-45. Nonsignificant zoning changes.
(a) The director may administratively grant any non-significant zoning change. A non-
significant zoning change must comply with the designations for the property set forth in the
general plan and any development plan adopted by ordinance, and must either:
(1) not result in a net increase in the density allowed in the zoning district(s) containing
the affected area; or
(2) be the lesser of a five percent or one acre increase or decrease in the area of any
zoning district(s).
The subject properties are both designated "Orchard" in the General Plan and there is no net
change in either zoning designation area.
The applicant believes this request is consistent with the Zoning Code, the General Plan and good
planning practices and request that you give a favorable consideration to this request for a
nonsignificant zone change.
