RESOLUTION AUTHORIZING THE FINANCE DIRECTOR TO EXECUTE GRANTS OF
EASEMENTS IN FAVOR OF NIU PIA FARMS, LTD.
WHEREAS, the County of Hawaii is the owner of a public right of way situated
at Kaloko, North Kona, Island of Hawaii, Hawaii, identified by Tax Map Key No.
(3)7-3-51; and
WHEREAS, a retaining wall approximately eleven (11) feet in height has been
built on an adjoining property (TMK No. (3)7-3-51:36) owned by Niu Pia Farms, Ltd. that
encroaches onto the public right of way in two (2) separate locations; and
WHEREAS, the Niu Pia Farms, Ltd. desire to purchase two (2) easements for
the portions of the retaining wall that encroaches onto the public right of way; and
WHEREAS, an appraisal for the easements was prepared by the Lawrence
Appraisal Group Hawaii, Inc. which appraised the easements at a value of $1,425.00;
WHEREAS, Niu Pia Farms, Ltd. desire to purchase the two (2) easements for
the sum of $1,425.00; and
WHEREAS, Section 2-111 of the Hawaii County Code states that the Finance
Director may be authorized by resolution of the County Council to grant an easement
for a particular purpose, subject to a reverter back to the County upon termination or
abandonment of the specific purpose.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, that, pursuant to Section 2-111 of the I-Iawai'i County Code,
William Takaba, Finance Director of the County of Hawaii, is hereby authorized to
execute grants of easements in favor of Niu Pia Farms, Ltd.
BE IT FURTHER RESOLVED, that the Clerk of the County of Hawaii transmit
copies of this resolution to William Takaba, Finance Director of the County of Hawaii.
