Re: Resolution 238-02, Draft 5
Dear Chairman Arakaki:
Councilmember Dominic Yagong has circulated a possible Draft 5 of Resolution 238-02 that
attempts to address my concerns about the proper separation of powers between the legislative
and administrative branches of the County government.
However, I do not agree with the wording as presented in Draft 5, and instead propose the
following to replace the final two "whereas" clauses:
WHEREAS, the Council would like to have an opportunity for input and collaboration
with the Mayor in the evaluation of proposals for an Integrated Solid Waste diversion
technology, and requests that for this reason, the Chair of the Committee on Parks and
Environmental Management and the Chair of the Committee on Planning be members of
the RFP Evaluation Committee, along with the committee members selected by the
administration; and
WHEREAS, the Council requests that the top final two proposals recommended by the
RFP Evaluation Committee be submitted to the Council for information and discussion.
This submission shall be in Executive Session to comply with the confidentiality
requirements of the State Procurement Code.
To replace the fourth and fifth "be it resolved" clauses, I propose:
BE IT FURTHER RESOLVED that the Chair of the Committee on Parks and
Environmental Management and the Chair of the Committee on Planning serve as members
of the RFP Evaluation Committee, along with the committee members selected by the
administration.

BE IT FURTHER RESOLVED that the top final two proposals recommended by the
RFP Evaluation Committee shall be submitted to the Council for information and
discussion in Executive Session before the final decision is made by the Mayor.
The language presented above allows for participation in the evaluation process by having two
members of the County Council actually sit on the RFP Evaluation Committee. In addition, the
top two final proposals will be presented to the full Council in Executive Session, allowing for
discussion and input from all members before a final decision is made.
It is my responsibility to follow the law as it is written, and I ask that the Council respect the
separation of powers that is established in the County Charter. Thank you for the opportunity to
present my position.
