Your Committee on Public Works and Intergovernmental Relations, to which was referred
Communication No. 797 and attached Bill No. 278, reports as follows:
Communication No. 797 is from Council Chair James Y. Arakaki, dated October 28, 2002, transmitting
the above bill for consideration. In his letter, Chair Arakaki explains that this legislation is being
introduced to eliminate existing contradictions and conflicts between county and state laws and rules, at
the request of the Disability and Communication Access Board (DCAB). He also reports that this bill has
been reviewed by Mayor Harry Kim, Corporation Counsel, Finance Department as well as DCAB.
The purpose of Bill No. 278 is to amend Chapter 24, Article 8, Division 6, the Hawaii County Code 1983
(1995 Edition), relating to parking for disabled persons by repealing Division 6 in its entirety and
replacing it with a new Division 6 entitled "Parking for Persons with Disabilities". The new division is to
be consistent with state law specifically Chapter 291, Part Ill of the Hawaii Revised Statutes, and
Chapter 1 1-219, Hawaii Administrative Rules. Bill No. 278 also clarifies the Office of Management as
the issuing agency for windshield placards, special license plates and identification cards.
At today's meeting, a letter from Dean Georgiev, Chair of the Disability and Communication Access
Board, in support of Bill No. 278 was received and circulated. In addition, items two through four located
on page number three of Bill No. 278, were amended with the following:
1. Chapter 291 D, HRS, and Title 1 1, Chapter 219, (HRS) HAR.
Your Committee on Public Works and Intergovernmental Relations is in accordance with the purpose and
intent of Bill No. 278, as amended to Draft 2, and recommends that it pass first reading.
