No. 770, dated Uctober 2002, authorises the Director of Finance to execute a ~~rant oi~
easement in t~ivor of Niu Pia farms. LTD.
The County of I~awai`i is the owner of a public ri~~ht ol~wa~~ situated at halol:o_ '~J~~rth hone.
[stand of Hawaii. I Iawai'i. identified b~ Tax Map Kc~ No. )7-;-~ 1.
The Niu Pia Farms. 1,td. desires to purchase two easements for the portions of the r~tainin~.~ ~~~~~ll
that encroaches onto the puhlic right of~ wav.
An independent appraiser determined that the fair market ~-aloe of the rctainin~ wall easement is
$1,425 with an area of 178 square feet.
Pursuant to Section 2-1 1 1, Ha~yai'i Count~~ Code, the finance director may he authorised h~
resolution ol~the Count~~ Council to .rant an easement for a particular purpose. suhject to a
reverter back to the County upon termination or ahandonment of the spccilic purpose.
An amendment was made to Resolution No. 2>1-(l2, ~yhich added the lax Map Key Nu. in the
second Whereas clause.
Your Committee on Finance is in accord ~~°ith the purpose and intent ~)f IZesulution No. 2~ 1-(12_
as amended to Draft and recol~~mends its adoption.
