Your Committee on Finance, to which was referred Resolution No. 2~8-02, reports as t~~llows:
Resolution No. 248-02, transmitted jointly with Bill No. 264 by Director of Finance
William Takaba, via Communication No. 758, dated September 25. 2002, authorizes the Office
of the Mayor to enter into Contract for Goods and Services Adm. Serv. Office Log No. 03-0 l 4
with the Department of Health, State of I-~awai`i, for Erosion and Sediment control ordinance
update and implementation services.
Under a Settlement Agreement between KELLY Plaintiffs, State Department of Health (DOH),
and the County of Hawaii, the State is required to provide $60,000 of EPA grant fiu~ds to the
County for its project to update the Grading Ordinance. This project includes the updating of
Chapter 10. Erosion and Sedimentation Control, of the Hawaii County Code and also
identifying, educating, and training the implementation of best management practices to protect
coastal waters, watersheds, and wetlands from soil erosion and sediment loss. Due to higher
anticipated project costs, DOH has now agreed to provide $70,000. The Settlement Agreement
also requires the transfer of $12.500 to the County from 1250 Oceanside Partners.
Pursuant to Section 46-7, I~awai'i Revised Statutes, county departments must obtain the consent
of the council to enter into agreements with the federal or state governments respecting action to
be taken pursuant to any of the powers granted by law to furnish, expend and receive any funds
or other assistance in connection with projects being or to be undertaken pursuant to those
powers.
This measure was deferred on October 8, 2002.
Your Committee on Finance is in accord with the purpose and intent of Resolution No. 248-02
and recommends its adoption.

13y motion duly made and seconded, the County Council amended Finance Committee
Report 295 with the following change:
13y letter dated October 21, 2002, Director of Finance William Takaba informed that the
"Settlement Agreement" amount was increased from $12,500 to $22,500
1) The amendment was made in Paragraph Numbe}~ 3: "Under a Settlement Agreement

Finance Committee Report 295, as amended, was adopted by the following voice vote:
