Your Committee on Finance, to which was referred Resolution No. 26;-02, reports as
follows:
Resolution No. 263-02, transmitted by Martha A. Rodillas. Private Secretary to
Corporation Counsel Lincoln S.T. Ashida via Communication No. 808, dated
November 6, 2002, authorizes the acceptance of funds from AT&T Wireless Services, Inc.,
for the payment of the costs of construction of a replacement radio system for the Hawaii
County Police Department ($1.402,350).
The County of Hawaii holds Fixed Mixed Microwave Services licenses, issued by the
Federal Communications Commission (FCC), for three 2 GHz Microwave Paths located,
in whole or in part, in the 2 GHz Band. The County operates a microwave
communications system on the Affected Paths utilizing 2 GHz microwave equipment.
which facilities operate .<~ithin the coordination distance specified by the FC'C with respect
to the AWS System in the Basic Trading Area (BTA).
AWS has determined that the 2 GI Iz microwave equipment may cause inter(erencc to the
AWS System in the RTA. As a result. AWS wants the County to voluntarily and
permanently cancel, delete, discontinue, decommission. surrender and terminate its
licenses and operating authority, which would terminate the County's right to use the
Affected Paths.
As an interim solution, the County and AWS have agreed to replace the 2 GHz microwave
equipment, while the County constructs the permanent replacement system. An agreement
is attached as Exhibit 1 to the resolution. Accordingly, AWS will purchase, install and test
a 6 GHz analog microwave radio system for the County of Hawaii. When it is completed,
the County will surrender its licenses to operate on the Affected Paths to the FC'C'. After
accepting the interim system. the County has voluntarily agreed to re-engineer the
County's equipment into the replacement system. A4~IS has agreed to pay $1.492, ,50 to
reimburse the County for the cost of constructing the police radio replacement system.

Pursuant to Article XIII, Section 1 >-12, Hawaii County Charter. the Council on behalf of
the County, may accept gifts of donations of money, securities or other personal property
or of real estate or any interest in real estate.
For informational purposes, Mr. Tyler voted kanalua twice.
Your Committee on Finance is in accord with the purpose and intent of Resolution No.
263-02 and recommends its adoption.
