AN ORDINANCE AMENDING C1-IAPTER 14 (GENERAL WELFARE) OF TIIE 1--IAWAI`I
COUNTY CODE 1983 (195 N~DITION), AS AMENLED, RELATING TO SMOKING IN
CERTAIN PLACES IN T I EE COUNTY OF ; lAWAI `I.

SECTION 1. Puzpose. The County Council finds that there are compelling public health
and safety reasons to protect nonsz~zoking employees and the general public from the hazardous
effects of cnvirotlmental tobacco smoke (ETS), more commonly known as "second-hand
smoke." ETS has beta: c~~termincd to cause a number of adverse health effects, including lung
cancer, childhood asthma, and los,~~er z~~:gpiratory tract infections, according to studiL~ by the
U.S. Surgeon General, Er,vironment~~l Protection 1lgcncy, and the National Research Council.
The purpose of this meas~.zre is to prohibit the smoking of tobacco or any other plant in certain
areas of the County.
Terms of this article shall be liberally construed to effectuate the puzposc stated in this section,
and shall be read in conjunction with applicable state laws governing smoking in the workplace
and public places. The Council recognizes that this ordinance is more stringent than Pa ~ 1,
Chapter 328K, ilawai`i Revised Statutes.
SECTION 2. Chapter 14, Article 4, of the I-tawai`i County Code, relating to smoking in
public places, is amended to read and be appropriately numbered as follows:

(a) As used in this article, unless the context requires otherwise:

(a) Summons or Citati~~n.
(1) There shall be provided for use by an officer or employee of the County duly
authorized to issue a >>z~r~nons or citation, or any police officer a fora of
summons or citation for ~.:se in citing violators of this :~rticlc ,which does not
provide for the physical arrest of such violators. The fon~ and contont of such
summons or citation shah be as adopted or prescribed by the administrative judge
of the distri~;t court, shall be printed on a form commensurate :with the form of
otxi.cr sumr~~-;ins or citations used in ;noderri methods of arrest, and so designed to
include all rccessaxy information to make the same valid ~vithin the l.a:vs and
regulations of tlc State a.nd the County.
(2) In every cage, ~~~hen a cit:~tion is issuLd, the original of the same shall be given to
the violG~t:,r~;), providod that 4he administrative judge of the district court may
prescribe tl>;:~t the viol;~tor be given a carbon copy of the citation and provide for
the disposit=on of the o~•?~ina1 and any other copies.
(3) Every citation shall be nu=~bered, and each carbon copy shall bear_ the same
number as i is original.
(b) Enforcement and ^<';tninistration of the provisions of section 14-23 shall be under the

smoking.

Nothing in this article shall be construed as superseding applicable fire code provisions.

SECTION 3. Matc~~al to be repealed is bracketed. Ne~rw material is underscored. In

SECTION 4. Severability. If any provision of this ordinance, or the application thereof
to any person or circu~~,sranee, is head invalid, the invalidity does not atTect other provisions or
applications of the ordin~:~~ce which ca.~~ be given effect ~,vithout the invalid provision or
application, and to this c~ d, the provisions of this ordinance are severable.
SECTION 5. This ordinance shall take effect six months after approval.
