AN ORDINANCE AMENL:~ING CH~~PTER 14 (GENERAL WELFARE) OF TIIE I~%~WAI`I
COUNTY CODE 1983 (19:~~ (~:DITION), AS AMENDED, RELATING TO SMOKING IN
CERTAIN PLACES IN T~~-1~: COUNTY OF HAWAII.
BE IT ORDAINED BY T H~=~: COUNCIL OF THE COUNTY OF HAST~~AI`I:
SECTION 1. Purpo~;. The County Council finds that there arc, compelling public health
and safety reasons to prott4t nonsmel`i~,g employees and the general public from the hazardous
effects of onvironznental- to'navco smo'~e (ETS), more commonly kno:~~n as "second-1-.and
smoke." ETS has been de':::ermined to cause a number of adverse health effects, including lung
cancer, childhood asthma., °nd lowcs~ respiratory tract infections, according to studios by the
U.S. Surgeon General, Fnvironn~ental Protection Agency, and the National Research Council.
The purpose of this measure is to prohibit the smoking of tobacco or any other plant in certain
areas of t'ne County.
Terms of this article shall be liberally construed to effectuate the purpose stated in this section,
and shall. be read i~1 conju~.tion with ~~pplicable state laws governing sinolcing in the ~x~orkplace
and public places. The C~T~.~ticil recognises that this ordinance is more stringent than Part 1,
Chapter 328K, Ilawai`i Revised Staiutes.
SECTION 2. Chapter 14, Article ~F, of the Hawaii County Code, relating to smoking in
public places, is amended to read and be appropriately numbered as follows:

Section 14-20. I~cf€:~~itiores.
(a) As used in th.iS article, iu~less the context requires otherwise:
[5]~ "Bar" i-neans an establishment [in ;which the sale and consumption of
intoxicating liquor on the premises is s~utl~orized under a license issued by the

Section 14-21. ~i~~hag~ition certain places open to t~eJ of sm~kin a~~ (~u~l!ic.)

(a) Except as otljw;;; ~;-ise provided [herein;] in this article, smoking shall be prohibited
in [t:he follo:~<~ing places ~=.~ithin the County:] all onclos~d ~laoes within tl~e County,
includinc ~i'_t7ot lixni+-~l +o the following places:
[(1) Elcv=~tors in buildings generally open to and used by the public, including
elevators in apa.rtrr~ent and oth:,r multi-unit ro:=ido~xtial buildings.]
[(2)]~l~[i'rivate ar~d cn~iprivate] Patientrooms, wards, :waiting rooms, lobbies,
and rublic h;~l1S,-ays of public and private health care facilities, including,
but not limite~:l to, hospitals, clinics, and physicians' and d;ntists' offices.
[(A) Nothing iz~ this section shall prevent a facility from cst:~z'~lisl~ing
waiting arias :{~l:~,ro smoking is permitted ~~rht-re smoking areas compgise

[(5)]~jf:e~=aurants .with a seating capacity of more th•~~n forty patrons.
(A) Nothing in this section shall prevent a restaurant of more than forty
patrons from providing smoking areas ~~vhich are reasor~a.bly
proportio~~ate to the preference of its users.

the major source of income is derived, provided that if the
restaurant services arc, provided in one section and the bar services

authorized to issue a sui~rznons or citation, or any police officer a fo,-m of
summons or ~;itatiori for use in citing violators of this article j=€~hich clces not

summons or citation sl~~ll be as adopted cr prescribed by the admi,~strz~tive judge

(b) Enforcemcrt and a'ninistrution of the provisions of section 14-23 shall be under the
jurisdiction of the i>;°:pu~-~nerxt of public works of the County, ~,vhich dopart~nent shall
have the power to fz,rrn~zlate any applicable ~2?1cs and regulations necessary to carry out
the provisions of sc.=tion 14-23.
(c) Except ar provided in section 14-24.1(b), enforcement of this ordinance shall be under
the jurisdiction of t>~ County police department.

Nothing in this article shall be constrazed as superseding applicable fire code provisions.
Where a conflict between tl~e provisions of this article and trc fire cod;, ax-iser, the fire code
provisions will prevail."
SECTION 3. Matc~-ial to be repealed is bracketed. New material is underscored. In
printing this ordinance, t'>:~ brackets at~d bracketed material need not be included.
SECTION 4. SevcE~ability. If any provision of this ordinance, or the application thereof
to any person or circurnst.a~nce, is held invalid, the invalidity does riot affect otl^ie= provisions or
applications of the ordinance .~,~hich can. be given effect without the invalid provision or
application, and to this c'>d, tl-~. previsions of this ordinance are severable.
SECTION 5. Tiis ordinance shall take effect six months after approval.
