RE: Conformity of Agricultural Dedications so that the Native Forest
Classification will be equal to other Agg Classifications
Dear County Council,
Dept. of Finance-Real Property Tax information sheet regarding
Agricultural or Ranch Land Dedication states, 'The dedication runs with
the land and binds successor-owners. If such lands are subdivided, each
subdivided parcel shall be independently subject to the dedication".
ORDINANCE NO. 96-71 regarding Dedication of Native Forests does not
state that the dedication runs with the land, but that "sale of the property"
would cancel the dedication. As a result of this non-parity with other agg
dedications, people in Kaloko Mauka have hesitated from applying for this
dedication.
In order to conform with other agricultural dedications and encourage
people to dedicate land to Native Forest, I am submitting specific
amendments to this Ordinance. As ttte Ordinance states, this tax incentive
is valuable for present and future generations to protect "hundreds of
plant species found nowhere else in the world, (protect) topsoil, and
watershed" so valuable to our water needs on this island.
On page 11 "or the sale of the property" should be~mitted
from paragraph (h).
In additional, I suggest adding item (j)
(j) The dedication runs with the land and binds successor-owners.
If such lands are subdivided, each subdivided parcel shall be independently
subject to the dedication.
